FOR THE CITY OF BATESVILLE, ARKANSAS_
A RESOLUTION ANNEXING TO THE CITY OF BATESVILLE, ARKANSAS,
CERTAIN LANDS LYING IN THE WEST HALF OF SECTION THIRTEEN,
TOWNSHIP THIRTEEN NORTH, RANGE SIX WEST KNOWN AS BALCH
SUBDIVISION TO INDEPENDENCE, ARKANSAS.
WHEREAS,on the first day of February, 1979, the County Court of
Independence County, Arkansas, entered its Order annexing to the City of
Batesville, Arkansas, the following described lands:
"Part of the A Section 13, Township 13 North, Range
6 West to wit: Begin at an iron axle for the West
section corner of said Section 13;
then run South 830 571 18" East 796.44 feet to point;
then run Southwest along a curve to the right central
angle 200 and radius 258.56 feet a distance of 90.25
feet to a point of tangency;
then run South 740 181 3111 West 300.00 feet to a point
of curvature;
then run Southerly along a curve to the left, central
angle 600 and radius 232.85 feet, a distance of 243.84
feet to a point of tangency;
then run South 140 181 3111 West 98.73 feet to the
northerly right-of-way line of Arkansas State Highway
No. 69;
then run South 720 461 East along said highway right-
of-way line 25.00;
then run South 750 411 2911 East along said highway right-
of-way line 25.00 feet;
then run North 140 181 31" East 100.00 feet to a point
of curvature;
then run Northerly along a curve to the right central
angle 600 and radius 182.85 feet. a distance of 191.48
feet to a point of tangency;
then run North 740 181 31" East 300.00 feet to a point
of curvature;
then run Northeasterly along a curve to the left, central
angle 200 and raduis 308.56 feet, a distance of 107.71
feet to a point of tangency;
- then run North 540 181 31" East 194.05 feet to the South
line of the NW's said Section 13;
then run South 890 201 26" East along said 4 section
line 423.66 feet to an Torn pin;
then run North 000 441 06" East 837.54 feet to an iron
pin;
then run West 62.04 feet to an iron pin;
then run North 000 441 06" East 220.00 feet;
then run South 630 321 17" West 231.42 feet;
then run South 840 521 44" West 890.68 feet;
then run South 760 491 19" West 51.51 feet;
then run North 890 151 5411 West 198.60 feet to the West
line of Section 13;
then run South 000 441 06" West 850.00 feet to the point
of beginning, being 31.00 acres."
WHEREAS that prior to the entry of the Order of Annexation by
the County Court of Independence County, Arkansas, the notice of the Petition
for Annexation having been filed and published in accordance with the laws
of the State of Arkansas; :and
WHEREAS there having been no objection to the annexation Of said
lands either prior to or within thirty (30) days after the entry of the Order
of Annexation; and
WHEREAS, on the 1-61--b day of March, 1979, the County Court
of Independence County entered its Order of Confirmation of the annexation;
and
WHEREAS, the above described property has been surveyed and
platted and layed out in residential lots with the zoning of R-1 pursuant
to established City Ordinances; and
WHEREAS, it is now proper and desirable that said lands be annexed
to the City of Batesville, Arkansas, therefore, be it hereby resolved that
the above described land should be, and they are hereby annexed to the City
of Batesville, Arkansas, and from and after this date all of the inhabitants
thereof shall have and enjoy all of the rights and privileges of citizens of
the City of Batesville, Arkansas.
