HomeMy WebLinkAbout1979-730-R RESOLUTION #730 A RESOLUTION DIRECTING THE CITY CLERK TO CAUSE TO BE PUBLISHED ONCE A WEEK FOR TWO (2) CONSECUTIVE WEEKS IN A NEWSPAPER PUBLISHED IN THE COUNTY OF INDEPENDENCE AND HAVING A GENERAL CIRCULATION WITHIN THE CITY OF BATESVILLE NOTICE OF A PUBLIC HEARING BEFORE THE CITY COUNCIL OF THE CITY OF BATESVILLE CONCERNING THE CLOSING OF CERTAIN PORTIONS OF 15TH STREET. WHEREAS, a petition to abandon a part of 15th Street has been filed by Troy Gray, owner of all property abutting a part of Fifteenth (15th) Street from the intersection of Norma Street and 15th Street South to the Mo.-Pacific Railroad Company Spur joining Chaney Drive, being 320 feet long and 50 feet wide, located within the City of Batesville, said petition being in legal form stating all legal requirements, and WHEREAS, said street has never been opened to the public, and WHEREAS, Arkansas law requires that notice of hearing be caused to be published by the City Clerk, BE IT THEREFORE RESOLVED by the City Council of the City of Batesville that: 1) A public hearing on said petition and abandonment of said street shall be held before the City Council , at City Hall on December 11, 1979 at 7:00 p.m. 2) The City Clerk of the City of Batesville is hereby ordered and directed to cause to be published in a newspaper pub- lished within the County of Independence and having a general circulation within the City of Batesville, notice of said hearing, said notice to be published once a week for 2 consecutive weeks. 3) Said notice shall conform to the requirements of Arkansas law Ark. Meachum, and prays that the Honorable Mayor and City Council of Batesville, Arkansas, to abandon the property dedicated and known as part of Fifteenth (15) Street from the intersection of Norma and 15th Streets South to the Missouri-Pacific Railroad Company Spur joining Chaney Drive, being 320 feet long and 50 feet �W wide, located in the City of Batesville,Arkansas. The Petitioner further states: 1. That the Petitioner is the owner of all property adjoin- and abutting thereto, except the property owned by the Missouri- Pacific Railroad Company next to Chaney Drive. 2. That 15th Street from Gray's Avenue South toward Chaney Drive was dedicated to the City in the 1930's and has never been opened to the public. 3. There has been no request for or need by the general public for the Street to be opened, nor would it serve any use- ful porpose to open it at this time. 4. That a building has been constructed and occupied on the southern part of said Street. �W THEREFORE, Petitioner respectfully request that the City Council by resolution direct the City Clerk to give noticeof hearing to determine whether such property should be abandoned by the City as required and set out in Ark. -Stat : 19-3814.
