KESULUi ION NO. T50 OF UHE CITY
COUNCIL FOR THE CITY OF BATESVILLE, ARKANSAS
A RESOLUTION AUTHORIZING THE MAYOK AND CITY CLERK nF THE CITY nF BATESVILLE
TO EXECUTE A CONTRACT FOR THE PURCHASE OF APPROXIMATELY 48.5 ACRES FOR
CITY PARKS_ RECREATIONAL AND OTHER PURPOSES FROM DONNIE AND THEO BRYAivT.
WHEREAS. the City Council of the City of Batesville. Arkansas on May 23rd.
1979 by resolution No. 726, authorized the Mavor and Citv Clerk to
execute a contract for the purchase of certain property from Donnie
and Theo Bryant and
WHEREAS, the terms of that contract have been fully complied with by all
parties and all conditions met and,
WHEREAS, the City Council of the Cite of Batesville feels that this
purchase will be in the best interests of the citizens of the City
of Batesville.
NOW. THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
BATESVILLE. ARKANSAS:
1. That the City Council of the City of Batesville. Arkansas hereby auth-
orizes the mayor and City Clerk of the Citv of Batesville, Arkansas to
purchase from Donnie and Theo Brvant a certain tract containing 48.5
acres, more particularly described as:
A nart of the 92 of Sw4 of Section 35. Township 14 North,
Range 6 West and a part of the NZ of NW% of Section 2_
Township 13 Nort1', Range 6 West. described th>>s: Commencing
at the Northwest corner of the NE-14 of NW;4 of Raid Section 2:
thence North a distance of 534.70 feet: thence East a
distance of 263.bO feet to the Point of Beginning at the
intersection of the East R/W line of Ark. Hwy w394 with
the South R/W line of a Mo-Pac Railroad Spur; thence
North 76 degrees 41 minutes 54 seconds East along said
South R/W line a distance of 5UO.00 feet to a point at the
end of existing steel tract; thence North 76 degrees 29
minutes 30 seconds East along said South R/W line a distance
of 191.65 feet: thence North 62 degrees 32 minutes 24 seconds
Fast along said South R/W line a distance of 477.4b
feet; thence South 02 degrees 52 minutes 19 seconds East

Tnat the iiayor and City clerk are authorized to execute all checks and
other neresGary in-tr>>ments to receive and record all deeds and accent,
on behalf of the city, as part of this transaction, a certain tract
containing five acres from said Donnie and Theo Bryant, more particularly
described as:
A part of the A, of NW-4 of section 2, Township l.s North,
Range b West, described thus: Commencing at the Northwest
corner of the NE-4 of NW% of said section 2: thence South
a distance of 6b0.UO feet: thence West a distance of
725.90 feet to the Point of Beainnina on the East R/W
line of Ark. Hwy v394: thence North 44 degrees 00 minutes
00 seconds East along said East x/W line a diGtance of
160.00 Leet: thence North 41 degrees 00 minutes 00 seconds
East along said Last R/W line a distance of 170.00 feet:
