RESOLUTION NO.
CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS
WHEREAS, a majority of owners of the land hereafter described, both
in number and in acreage, have petitioned the County Court of Independence
County, Arkansas, for the annexation of said land to the City of Batesville,
Arkansas, the said land being described more fully on Exhibit "A' attached
hereto and incorporated herein by reference as if set out word for word and
figure for figure; and,
WHEREAS, after proper notice being published in accordance with
the laws of the State of Arkansas, a hearing was held by said Court on the
29th day of October, 1980, and at said hearing the petition for annexation
was granted and an order of annexation was entered on the 29th day of October,
1980, subject to acceptance by the City Council for the City of Batesville,
Arkansas, and confirmation by the County Court; and
WHEREAS, no notice of any proceeding to have the annexation prevented
has been given to either the proper city authorities or the proper agents of
the land owners within thirty (30) days frar!m the making of the Order of
Annexation by the County Court; and
WHEREAS, it is the opinion and belief of the City Council of the
City of Batesville, Arkansas, that the annexation of the said land described
herein would be in the best interest of the City of Batesville, Arkansas.
BE IT THEREFORE RESOLVED, That the real property described herein
should be, and it is hereby, incorporated into the City of Batesville, Ark-
ansas; that the County Clerk is authorized to forward copies of this
Resolution, along with other appropriate documents, to the proper officials;
that upon the effective date of this Resolution the owners of the real
property described herein shall have and enjoy all the rights and privileges
as other residents of the City of Batesville, Arkansas.

h tract of land being part of the Southeast Quarter of Section 3 and part
Of the Northeast Quarter of Section 4 in Township 13 North, Range 6 West of the
Fifth Principal Meridian in Independence County, Arkansas more particularly
described as follows:
Beginning at the intersection of the North Right-of-Way Line of Ark.
Hwy. 25 with the East Right-of-Way Line of Ark. Hwy. 233 and or 394 (formerly
US Hwy 167) , said point being 50 feet North and 18 feet East of the Southwest
corner of said Southeast Quarter of Section 3; thence N 01021'E along said East
R/W Line of Ark. Hwys. 233/394, a distance of 401.4 feet; thence Northeasterly
along said East R/W Line on a curve to the right having a 1,085.91 feet radius
and a central angle of 34019' , a distance of 650.37 feet; thence N 35040' E
along said East R/W Line, a distance of 20.0 feet; thence N 89053' E, a distance
of 210.28 feet; thence N 35002'03" E, a distance of 210.05 feet to a point on
the South Right-of-Way Line of the Old Dethrow Road; thence Easterly along
said South R/W Line to a point that is 1,292 feet more or less West of the
Centerline of Miller Creek; thence North a distance of 172 feet; thence East
a distance of 147 feet; thence Northeasterly along the Williams property line,
a distance of 242.9 feet to the South Line of the Theatre Tract; thence East
along said South Line, a distance of 405.9 feet; thence S 030 W with the extension
of the East Line of the Theatre Tract, a distance of 209.9 feet; thence East,
a distance of 724 feet more or less to the Centerline of Miller Creek; thence
Southerly along said Centerline to a point on the South Right-of-Way Line of
Ark. Hwy. 25; thence Westerly along said South R/W Line to a point on the East
Right-of-Way Line of Arkansas Hwys. 233/394; thence Northerly to the Point of
Beginning. Containing 62 acres more or less.
