discontinued by the said Choate, his successors or assigns,

WHEREAS, Tom Choate, of Newport , Arkansas, has re-
quested that he and his associates, successors, or assigns,
be granted an exclusive right or franchise to serve the
area in the City of Batesville, Arkansas, and all the
inhabitants thereof with direct wire receptytl 6n.i.-, of tele-
vision programs as relayed to his communityltelevision
aerial from a connection with coaxial cablesat nearby
points; AND, i
WHEREASI , this service is a needed convenience for
the City of Batesville and its inhabitants; AND,
1-1HEREAS, a definite commitment from the City of
Batesville is necessary before Choate, his associates,
successors, or assigns , can commit themselves financially
for the installation and construction of the� utility; AND,
WHEREAS, It is not possible to define as definite-
ly as is desirable the exact terms of the franchise; NOW
THEREFORE,
BE IT RESOLVED That, for and in consideration of
Ten Dollars ($10.00) and other good and valuable consid-
erations, receipt of all of which is acknowll dged, the
City of Batesville hereby grants to Tom Choate, his succes-
sors or assigns , the exclusive right to serve the people
of Batesville with direct wire reception of t1elevision
programs as relayed to a Batesville installed, community
television aerial for a term of (5) Five years
from this date, and the officers of the City are directed
to negotiate with Choate a detailed franchisejcontract
incorporating these terms and submit to the City Council
for approval, which contract shall provide th t the said
Choate shall commence construction within
