RESOLUTION
Whereas, a petition has been filed with the City
Council signed by Malcom Moore and Edith Moore, his wife, Donald
Hedden and Emma Lou Hedden, his wife, and Guy Moseley and Sarah
Moseley, his wife, beingall of the property owners adjoining
George Street in Ball's Addition to the City of Batesville,
Arkansas, as shown in Deed Record Book L-6, page 274-A, petition
ing for the abandonment and vacation of George Street, now
THEREFORE, BE IT RESOLVED by the City Council of the
City of Batesville, Arkansas, in meeting duly assembled on this
day of '�" , 1961 that:
1. Said petition be accepted and filed.
2 . That a public hearing be set for the hearing of
this petition and all interested persons thereon on the
day of , 1961.
3 . That the City Clerk shall give notice of this
hearing by publication once a week for two consectutive weeks in
a newspaper having a bona fide circulation in Batesville, Arkansas .

PETITION
Whereas, Malcom Moore and Edith Moore, his wife, and
Donald Hedden and Emma Lou Hedden, his wife, are the owners of
Lots 5, 6 and 7 in Block 2, and also Lots 1, 2 and 3 in Block 3
of Bail's Addition to the City of Batesville, Arkansas, as shown
by the plat of said Addition recorded in Deed Record Book L-6,
page 274-A, and desire to rededicate this area and these parcels
of land and relocate streets abutting thereto, and
Whereas, Guy Moseley and Sarah Moseley, his wife, are
the owners of Lots 1, 21 3 and 4 of Block 2, Ball's Addition of
the City of Batesville, Arkansas, as shown in plat recorded in
Deed Record Book L-6, page 274-A, and also of the following ad-
joining lands, to-wit: A part of the Southeast Quarter of the
Southwest Quarter of Section 9, Township 13 North, Range 6 West,
described as follows: Commencing at the quarter section corner
between Sections 9 and 16, Township and range aforesaid; thence
West 65 links; thence North 341 links to a point where the North
line of Main Street intersects the line between Ball' s Addition
and the Powell Motel tract; thence South 54 degrees West along
the North line of Main Street 355 feet to a limestone rock in the
middle of George Street for place of beginning; thence North 368
feet to a point; thence West 526 feet; thence South 240 feet;
thence West 12 feet; thence South 150 feet to a point on the line
between said Sections 9 and 16; thence East along said line 519
feet, more or less, to a point where said line intersects the
North line of Main Street, said point being 338 feet West from
the quarter section corner between said Sections 9 and 16; thence
North 54 degrees East along the North line of Main Street 17 feet

to the place of beginning. Also, all of fractional block 59 of
School Addition of the City of Batesville, Arkansas, in form of
a triangle, said triangle fronting 234 feet on Twekth Street,
329 feet on Main Street and 405 feet on the line between Section
9 and 16 of Township 13 North, Range 6 West, and desire to
abandon George Street, now Therefore
All property owners to all lands which join George
Street, as hereinabove set out, desire to abandon and vacate
George Street; that George Street has never been opened and used
as a public street; that it has not been used by the public for
the last five years; that all of the property owners effected by
this street are petitioners herein and that said street should be
abandoned and vacated and title revested in these petitioners .
A copy of the plat of George Street is attached hereto
and made a part hereof as though set out herein, word for word.
Wherefore, petitioners pray that the City Council by
resolution set a date for hearing upon this petition and that on
such hearing that said street be vacated and abandoned as a
public street.
