HomeMy WebLinkAbout1965-06-01-R RESOLUTION OF THE CITY COUNCIL OF BATESVILLE i WHEREAS the A"*kansas Power and Light Company has offered to furnish to the city of Batesville certain land and property free of charge for a new right-of--way and relocation of Oak Street, and WHEREAS the cit of Batesville has j y passed an ordiance closing portions of Eleventh Street and Oak Street, and WHEREAS Arkansas 'ower and Light Company has executed or will execute a ouitclaim deed to the city of Batesville conveying all interest it has in and to certain described property and, WHEREAS Arkansas Power and Light Company and Kerr-McGee Oil Industries , Inc . are the adjoinin ; owners of property along the closed portions of Oak Street and Eleventh Street and there is i no longer any need for said streets and, WHEREAS the city of Batesville now makes no claim of interest in and to said property which has been vacated and abandoned as streets, now; THEREFORE BE IT `ESOLVED BY THE CITY COUNCIL OF BATESVILLE, AiV. AN AS 1) That the mayor of the city of Batesville be and same is hereby authorized to execute a quitclaim deed to the Arkansas Power and Light Company conveying the following described propert : All that property known formerly as Eleventh Street and Bounded as follows : Eleventh Street between Oak Street and St. Louis Street, being bounded on the West by Frl. Lot 5 of Frl. Block 53 and on the East by Frl. Block 54 All in the School Addition to the City of Batesville, Ark. 2) That the mayor of the city of Batesville be and the same is hereby authorized to execute a qus_tclaim deed to the Kerr-McGee Oil Industries conveying the following described property: I All of that property known formerly as Oak Street and described more particularly as follows : Oak Street between a point North 54 degrees East from the Southwest corner of Block 44 and the ?Nest line of S _ Louis Street on the North line of Oak Street and a point North 54 degrees East 7 feet from the Northwest corner of Frl. Block 54 to the West line of St. Louis Street on the South line of Oak Street, being more particularly described as follows : Beginning at a point on the South line of Block 44 that is North 54 degrees East 20 feet from the Southwest corner of said Block 44; thence North 54 degrees East 38 feet, more or less , to the hest line of St. Louis Street; thence South on said line 45 feet, more or less to the North line of Frl. Block 54; thence South 54 degrees Jest along said North line 22 feet; thence North 18 degrees West 42 feet to point of beginning c f t i Excepting from the above conveyance however the following described lands : Beginning at a point on the North line of Oak Street as now located and the South line of Block 44 that is North 54 degrees East 20 feet from the Southwest corner of said Block 44, thence East 30 feet to the West Line of St. Louis Street; thence South on szid West line 40 feet; thence West 18 feet, more or less , to the South line of Oak Street as now located and the North line of Block 54; thence North 18 degrees West 42 feet to point of beginning. All in School Addition to the City of Batesville. 3) That the city Clerk will duly attest said deeds in his offical capacity and affix the seal of his office. Association, being the owner of the land as described in Exhibit �i f� A which is attached hereto and made a part of this petition as i� j though set out herein word for word and represents to the City �j Planning Commission as follows : "That the lands now owned by the petitioner ii have been zoned as commercial and that this action was taken by the City Planning Commis- sion at the time that the property wasowned fi by Mr. Malom Moore. That at the present time th4etitioner plans and has made exten- sive plans including allmatters necessary to !� construction for an office building on said property and that it would be to the best interest of the petitioner that the set back from Harrison Street in this particular case be determined to be _�:�`�_I i feet and that the set bac i allowed by the I� City Planning Commission would not be prejudi- cial to any of the property owners in the immediate vicinity nor would it in any way prejudice the total Irogram of the City j Planning Commission. Land owned by 'White River PCS as conveyed by a deed now recorded in Book R-8 at Page 369 of the deed records of Independence County: Trot 1 of fractional Block 2 of Bates Addition to the City of Batesville: It being a strip off of the Fast side of said Block 60 by 150 feet in the shape of a parallelogram extending vast 60 feet from the alley between Blocks 2 and 3 (60 feet frontage on Harrison Street and extending south 150 feet), .*AW
