RESOLUTION NO. 700
A RESOLUTION EXPRESSING THE WILLINGNESS OF THE
(W CITY OF TO COOPERATE WITH
THE OFFICE OF THE COORDINATOR OF PUBLIC SAFETY
AND OTHER AGENCIES IN THE PPE-PARATION OF A
SIGNING STUDY AND PROGRAN FOR
THE CITY OF Batesville, Arkansas
WHEREAS, the City of Batesville, Arkansas desires to enter
into a program for upgrading its "Stop" & "Yield" signs; and
WHEREAS, the program will correct signing deficiencies along
city streets not on any Federal-aid System; and
WHEREAS, the installation of these signs are financed on 90
percent Federal and 10 percent Local funding; and
WHEREAS, this program will provide a safer and smoother traffic
flow;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
(W OF Batesville , ARKANSAS, THAT:
SECTION I: The Mayor is hereby authorized to enter into an
agreement with the Office of the Coordinator of Public Safety pertain-
ing to the conduct.:of a signing study for the City of Batesville
SECTION 2: The City of Batesville pledges its full
support and cooperation to the Office of the Coordinator of Public Safety
and to all other agencies involved in the project.
SECTION 3: The City of Batesville will participate,
in accordance with its designated responsibility, in the implementation
of the recommendations provided in the approved study.

AGREEMENT OF UNDERSTANDING
BETWEEN

In Cooperation With the
U.S. Department of Transportation
Federal Highway Administration
And
Arkansas Highway Department
RELATIVE TO
The establishment of a cooperative program for correcting signing
deficiencies on streets and roads not on a Federal-aid system, phase II .
WHEREAS, Section 405, Title 23, U.S. Code, provides funds which can
be used to correct sign deficiencies on non-Federal-aid routes on a 90%
Federal-10% Local matching basis; and
WHEREAS, it is the desire of the of
hereinafter called City, and the Office of the Coordinator of Public Safety to
implement a project to up-grade the signing in the City to conform with the
Manual on Uniform Traffic Control Devices (MUTCD) .
IT IS HEREBY AGREED that the City and the Office of the Coordinator
of Public Safety, in cooperation with the Federal Highway Administration and
the Arkansas Highway Department, will participate in a cooperative program for
implementation of a signing project; and
HEREBY , accept the responsibilities and assigned duties as related
in the following paragraph:
THE CITY WILL:
1. Adopt any necessary ordinance or ordinances required for
the implementation of the project.
2. Obligate by appropriate means and provide satisfactory-
surety
atisfactorysurety by a certified check for 10% of the project cost.

3. Review plans and comment on locations and type of warning
device to be used.
4. Agrees to maintain all signs installed by this project with
replacements to be of comparable quality of material and
workmanship as the original program installation.
5. Hereby attest that the employment policies and practices with
regard to its employees , any part of whose compensation is
reimbursed from Federal funds, will be. without regard to
race, color, religion, sex or national origin.
THE OFFICE OF THE COORDINATOR OF PUBLIC SAFETY WILL:
1. Be responsible for the necessary submissions to the Federal
Highway Administration.
2. Provide Traffic Engineering assistance to the City upon
request for implementation of proposed and future projects
through Section 405, Title 23, U. S. Code.
3. Develop the necessary plans , specifications and award con-
tracts and supervise construction of all projects accomplished
as a result of this agreement.
4. Be responsible for insuring that Appendix A of Title VI of the
1964 Civil Rights Act is physically incorporated within each
contract for projects constructed under this program.
IT IS FURTHER AGREED that should the City fail to fulfill its re-
sponsibilities and assigned duties as related in this agreement, such failure
will disqualify the City from the future Federal-aid participation on projects
for which the City has maintenance responsibilities .
IT IS UNDERSTOOD that the implementation of this agreement is subject
to the availability of Federal-aid funds.
IN WITNESS WHEREOF, the parties thereto have executed this

BEFORE THE CITY COUNCIL OF BATESVILLE, ARKANSAS

WHEREAS, the Batesville City Council met today, 14 October
1977, at 4: 30 P.M. in special session and for cause removed Mr.
Earl Hodges as a Commissioner from the Civil Service Commission
by unanimous vote.
Adopted this 14th day of October, 1977 .
