M-8020(7) RE S O L U T I O N — — — — — — — — — — Now on this day there comes on for consideration the matter of } improving certain city streets known as the Federal Aid Urban System which System is a part of the approved Federal Aid System of this s City. And it appearing to the City Council that under existing Federal Legislation certain Federal funds are available to aid in the improvement of street radii on said streets under the provision of the following agreement, which is tendered to the City for { execution. : . z _ Y y - - - - - - - - - - - F CONSTRUCTION AGREEMENT 1. This evidence's an agreement between the City of Batesville and the Arkansas State Hiway and Transportation , artment for the im- } 3 proving of certain city streets described a's-4the Federal Aid Urban `System, which System is part of the approved Federal Aid System of if said City. F 2. Under the Federal Aid Highway Act of 1973, Federal funds are " made available which may be used for payment in part for the work contemplated by this agreement under condition that not less then thirty percent of the cost of the construction and construction r engineering, plus the full cost of all nonparticipating items be 41 7 borne by the City and/or State and the work be performed in accor- dance with plans and specifications approved by the Arkansas ;r f t State Highway and Transportation Department and the. work supervised fi by the Arkansas State Highway and Transportation Department. 3. The plans and specifications for the construction of the System have been approved by the Arkansas State Highway and Transportation 9 A Department and are on file in its office in Little Rackand in the office of. the Mayor of the City of Batesville and have been approved and accepted by the City of Batesville . 4. The City of Batesville has elected to perform the proposed work with its own forces , equipment , and materials which work is described as follows : Improvement of street intersection radii . S . In furtherance of this project , the City of Batesville , as Sponsor of this project , has made a Performance Bond, executed by a Bonding Company authorized to do business in this State , in the penal sum of $63 ,500. 00 which is 100 percent the estimated cost of said work and the materials . 6 . The City of Batesville , as Contractor , agrees to perform this work at the unit prices shown on the attached proposal schedule. As the work undertaken by the City of Batesville hereunder g. progresses , the Arkansas State Highway and Transportation Department in its supervision thereof will from time to time issue partial estimates , based on work performed at the Negotiated Unit Prices until the work is completed and will credit to or pay to the City of Batesville in accordance with paragraph No . 2 hereof , from Federal funds received for account of this project , Ninety percent of such estimates , subject to the limitations and withholdings contained in Section 109 of the Standard Specifications for Highway Construction , Arkansas Highway Commission , Edition 1972 , and final payment will be qWmade upon the completion and acceptance of said job , subject to correc- tion for changes made in the final voucher as paid by the Federal Highway Administration. 7. The City of Batesville agrees , for the consideration herein- after expressed to begin work within ten days after a Work Order is issued by the Chief Engineer and to complete the work within two hundred seventy five work days . Should the said City of Batesville fail to complete the work within the time limit herein specified, said City shall pay to the State Highway Commission, as liquidated damages , ascertained and agreed, and not in the nature of a penalty, the sum of twenty five dollars ($25. 00) for each day delayed, which shall be deducted from the final amount of estimate made the City. Should the said City of Batesville fail to complete the work in AFKI an acceptable manner, or default in any requirement of it hereunder , the Arkansas State Highway and Transportation Department shall have the right to complete all or any portion of the work with means at its command and pay for same from funds to be realized from the Performance bond set up in paragraph No. S . In no case can any portion of the construction cost of this pro- ject be borne by the Arkansas State Highway and Transportation Department. 8, The City of Batesville further agrees upon completion of the project to assume the maintenance of the installation by City forces and/or others in accordance with the prevailing applicable federal and Arkansas State Highway Commission regulations . And it appearing further to the City Council that it is to the best interest of the City that this work be done v.'ith City forces and that it is proper that the proposed agreement he executed in behalf of this City. It is therfore , considered , ordered and adjudged that the Mayor of this City execute for and in behalf of this City the foregoing agreement, bond and application for bond binding this City to the provisions thereof. List detailed project objectives. These should be specific results desired by specific dates. Objectives should be quantitative whenever possible. SEE ATTACHEMENT # 1 2. Describe the specific activity for which Commission financial assistance is being sought and outline the major com- ponents (such as data collection and analysis, market feasibility, preliminary engineering, surveys, etc.). The specific activity for which financial assistance is being sought is for the acquisition of a professional firm to develop a plan by which the economic base of the downtown area may be stimulated in order to deter any further deterioration and disinvestment which has led to decreased employment and a shrinking retail market. The major components of the study will be the analization of traffic flows and land use characteristics, interviews with merchants and consumers so as to coordinate the outcome of the final plan and the preparation of preliminary engineering designs which will be followed by final engineering designs pending approval of the plan. The plan will additionally provide methods for addressing traffic conjestion, desolation of buildings and anti-aesthetic features. T-5-77 ATTACHMENT #1 The project objectives as set forth by the Downtown Merchants Association in conjunction with the City Mayor and specific timetables for achieving these. objectives are as follows: Objective #1 . Contact reputable consultant firms with competence in downtown development and request resume's and quantitive proposals for the project and select qualified firm within thirty days to initiate analysis. 2. Survey and Analysis. Chosen firm will meet with Downtown Merchants Association and the City's representatives to establish objectives of program and allow interested partici- pants to voice concerns. At this time, the chosen firm will initiate analysis of trade area and work with merchants collecting information on present conditions of the downtown area in regard to land use, parking, traffic flows, building conditions and consumer traits and characteristics. Time frame, 30 days. 3. Initiate Planning Phase. At this time, after analization of available data, planning firm will begin preparations of design concepts and hold meetings with interested citizens and local groups so as to insure public acceptance of project and _explore all feasible alternatives. Time frame, 45 days. 4. Review and Adoption. Preparation of final plans, cost estimates evaluation of viable alternative, development of visual program to be presented to city council , •public groups and interested municipalities. Describe the need of the area for the project and how the project will satisfy that need. (Consider such items as in- creased employment opportunity, increased income, improved community services or facilities, etc.) (W SEE ATTACHMENT # 2 3. Discuss any regional (multi-state) significance the project might have. The City of Batesville, Arkansas has been designated by the White River Planning and Development 'District as one of the three Economic Development Centers for this area which is composed of ten rural counties. The reason for Batesville's selection was growth potential , proximity and accessibility to re-development areas, services provided, etc. The approval and implementation of this project-for the downtown area should serve as a stimuli for similar projects within�he District and concurrently encourage downtown development hand-in-hand with improved community services which is basically dependent on pedestrian traffic in a rural community. T-5-77 Aft ATTACHMENT # 2 AV The proposed plan is to address the further development of the downtown trade area. For many years the downtown area has been the focal point of employment outside of industrial concerns and has also served as the main provider of community services and facilities. However, with the decline of economic activities in the area, it is feared that further disinvestment will lead to the locating of community services facilities outside of this area which now encompasses the following service entities : I . U. S. Post Office (new building) 2. Library ( renovated ) 3. City Hall 4. Jail Facilities 5. First National Bank 6. Citizens Bank 7. Batesville Federal Savings & Loan Association 8. Alcholic Recovery Center 9. Gray's Hospital 10. Fire Department 11 . Police Station 12. Employment Security Division 13. Chamber of Commerce 14. Southwestern Bell Telephone 15. Arkla Gas Company 16. Various other private establishments In regard to employment opportunities, commercial operations have had no opportunity to increase employment due to the current decline in retail sales which can be contributed to the random development of shopping malls, which have distracted the concentration of retail trade areas and community services which should exist coherently in a rural setting due to limited transportation facilities available for consumers. The proposed program will concentrate improvements in the downtown area which presently contains the forementioned community service facilities and will hope- fully spur interest in locating additional service facilities in this area while simultaneously increasing employment opportunities. A question as to the development of the downtown area of Batesville has only recently came to light due to the decrease of economic activity taking place in what was at one time the economic "hub" of Independence County. The need for this project has been demonstrated by the Downtown Merchants Association and the Mayor of Batesville, who are in agreement that further deterioration of this major economic base will deter further investments in the community and will encourage a form of "sprawl . " ; t-t, r . - t 2. State how the project assists in carrying out the goals, objectives and strategies of the ORC Economic Development Action Plan. If properly coordinated, this project will directly contribute to the generation of job opportunities and further "spin-off" created by increased economic activities will indirectly create additional job opportunities. In addition, this plan will direct development activities in a coordinated manner and will prohibit the probability of random development with no significant impact. 3. Identify the responsible agencies and/or organizations who will utilize the findings. The plans which will evolve from this project will be utilized by the Downtown Merchants Association in conjunction with the City in creating a more viable economic and aesthetic environment in the downtown area of Batesville. The expected outcome is to provide a detailed plan which can be used to create a positive economic atmosphere which will ,attract consumers and therefore increase the potentiality of increased job opportunities and community development.
