RESOLUTION BEFORE THE CITY COUNCIL
FOR THE CITY OF BATESVILLE, ARKANSAS
RESOLUTION NO. 7/
WHEREAS, Kimmswick Corporation and William Kibe and
Virgil Milligan have petitioned the City Council for the vacation
of a platted but unopened street named Finch Street in Quail
Valley Addition to the City of Batesville, Arkansas; and
WHEREAS, a hearing should be held before the City
Council for the City of Batesville on said Petition, be it now
resolved that the hearing on said Petition shall be held on
4 '1100 T.K.
January 9, 1979,gin the City Hall of the City of Batesville,
Arkansas . Notice of the hearing shall be published once weekly
for two consecutive weeks in a newspaper having a general
circulation in Independence County, Arkansas , and all interested
persons are invited to attend and make known their position on
the closing of said street .

BEFORE THE CITY COUNCIL
FOR THE CITY OF BATESVILLE, ARKANSAS
PETITION TO VACATE STREET
The undersigned, owners of Lots 7 and 8, Block 6, and
Lots 1 and 10, Block 7 of Quail Valley Addition to the City of
Batesville , Arkansas , as shown by Plat recorded in Book M-11, page
623 of the Independence County Records , hereby Petition the City
Council for the City of Batesville, Arkansas , as follows :
1 . That Finch Street, as shown by the Plat recorded
as set out above, a true copy of which is attached, is a fifty ( 50
foot unopened street which runs between Lots 7 and 8 of Block 6
and Lots 1 and 10 of Block 7 of Quail Valley and between Lots 7
and 8, Block 4 and Lots 1 and 10 of Block 5.
2. That Kimmswick Corporation, the owner of more than
fifty percent (50% ) of the lots in Quail Valley Addition to the
City of Batesville, Arkansas , and authorized by the Deed of
Dedication and Bill of Assurance, as amended, of Quail Valley
Addition to amend the Bill of Assurance has now caused a replat
of Lot 1, 6 thru 10 of Block 5; Lots 7 thru 10, Block 4; Lots 3
thru 7 and 8 thru 13 of Block 6; all of Block 7; and Lot 1, 5 thru
12 of Block 8 to be prepared by Miller-Newell Engineers , Ltd. ,
registered surveyors ; that a true copy of said plat is attached
hereto .
3. That in said replat, Robin Street is extended fully
so that it connects with Rutherford Road, and becomes a through
street; that because of this there is no reason for the continued
ex1tence of Finch Street .
4 . That the public interest and welfare of the City of
Batesville will not be adversely affected by the vacation of
Finch Street.
5. That the Petitioners herein are all of the land-
owners of the lots abutting the street to be vacated.
WHEREFORE, the Petitioners pray that the City Council,
by resolution, set a date for a public hearing on the Petition
so that Notice of the hearing may be published as required by
law.
