MAY 12, 1998
The Batesville City Council met for its regular meeting on May 12, at 5:30
P.M. at the Municipal Building. Mayor Joe Biard presided over the meeting.
Councilmember Insell gave the invocation. Upon roll call, all the council
answered present. Also present were the City Clerk and the City Attorney.
Councilmember Cargill moved to approve the minutes from the last
meeting and Councilmember Gaither seconded. All voted for.
Councilmember Ford moved to approve the prepared agenda and
Councilmember Insell seconded. All voted for.
CONSIDER AN ORDINANCE TO RE-ZONE CERTAIN PROPERTY IN EAGLE
MOUNTAIN FROM R-1 TO C-3
Mayor Biard read an ordinance that would re-zone certain property in
Eagle Mountain from R-1 to C-3. The property is located on Eagle Mountain
Blvd. near the Harrison Street intersection and will be used as a dental office.
Councilmember Cargill moved to suspend the rules and place the ordinance on
the second reading. Councilmember Carpenter seconded and the roll call count
was 8 for and 0 against. The Mayor read the ordinance for the second reading
and Councilmember Carpenter moved to further suspend the rules and place the
ordinance on the third reading. Councilmember Pectol seconded and the roll call
count was 7 for and 1 (Mitchum) against. The Mayor read the ordinance for the
final reading and Councilmember Cargill moved to adopt the ordinance.
Councilmember Carpenter seconded and the roll call count was 7 for and 1
(Mitchum) against. The motion passed and the ordinance was given #98-5-1.
CONSIDER AN ORDINANCE TO ANNEX A SMALL TRACT OF LAND ON
HIGHWAY 167 NORTH — COLLIER PROPERTY
Mayor Biard read an ordinance that would accept the annexation of
certain property to the City of Batesville located on Highway 167 North across
from the Ramada Inn. Mr. Bob Stroud was present to answer any question from
the council. Mr. Stroud said the land surrounding the property is in the City limits
and the property is currently up for sale. Councilmember Bone moved to
suspend the rules and place the ordinance on the second reading and
Councilmember Cargill seconded. The roll call count was 8 for and 0 against.
The Mayor read the ordinance for the second reading and Councilmember Cargill
moved to further suspend the rules and place the ordinance of the third reading.
Councilmember Carpenter seconded and the roll call count was 8 for and 0
against. The Mayor read the ordinance for the final reading and Councilmember
Gaither moved to adopt the ordinance. Councilmember Pectol seconded and the
roll call count was 8 for and 0 against. The motion passed and the ordinance
was given #98-5-2.
MAYOR'S ANNOUNCEMENTS
The Mayor said that parking in the downtown area was a growing
problem. He said that he had appointed a committee to study the parking and
offer suggestions for correction. The committee consists of Councilmembers
Insell, Chairman, Pectol, Ford, and Gaither.
EXECUTIVE SESSION
Councilmember Cargill moved to go into executive session and
Councilmember Insell seconded. All voted for.
No action was taken in the executive session.
CEMETERY RESOLUTION
The council considered a cemetery resolution for Consuelo Lambert, #98-
132-1, for $200.00. Councilmember Bone moved to accept the resolution and
Councilmember Cargill seconded. All voted for.
FINANCIAL STATEMENT
The council was given a copy of the financial statement for the month
ending 4/30/98.
REVIEW BILLS
After a review of the bills, Councilmember Gaither moved that they be paid
and Councilmember Cargill seconded. All voted for.
There being no further business, Councilmember Mitchum moved that the
meeting be adjourned. Councilmember Gaither seconded and all voted for.
