HomeMy WebLinkAbout1998-09-22 MINUTES OF COUNCIL SEPTEMBER 22, 1998 The Batesville City Council met for its regular meeting on September 22, at 5:30 P.M. at the Municipal Building. Mayor Joe Biard presided over the meeting. Councilmember Insell gave the invocation. Upon roll call, all the council answered present. Also present were the City Clerk and the City Attorney. Councilmember Cargill moved to approve the minutes from the last meeting and Councilmember Pectol seconded. All voted for. Councilmember Gaither moved to approve the prepared agenda as amended. Councilmember Ford seconded and all voted for. DISCUSSION OF "TRUCKS PROHIBITED" SIGNS ON MAIN, COLLEGE AND BOSWELL STREETS Mr. Elmer Kirk and Attorney Butch Ketz approached the council asking for them to reconsider the wording on the signs on Main, College and Boswell Streets. The signs currently read "No trucks or trailers including livestock vehicles — delivery vehicles excluded". Mr. Ketz said the sign puts a great burden on citizens in town who own horses and pull horse trailers. He also said it was hard for those who buy and sell at the sale barn, which is located on lower Main Street. The Mayor said the original intent for the signs was to prohibit 18- wheelers from traveling these streets. The weight of the vehicles does extensive damage to the pavement. The Mayor said he also had several complaints from citizens on the streets regarding large trucks including livestock trailers. Councilmember Ford moved to remove the signs and carefully consider new wording for the signs. Councilmember Insell seconded and all voted for. ANIMAL CONTROL ORDINANCE — THIRD READING Mayor Biard read the animal control ordinance for the third reading. The council discussed the wording of the ordinance regarding livestock in the city limits. It was agreed that the wording needed to be changed, therefore, Councilmember Gaither moved to table the ordinance until such changes could be made. Councilmember Pectol seconded and all voted for. PUBLIC HEARING FOR CLOSING CHURCH STREET Mayor Biard officially opened the public hearing for the purpose of closing Church Street. The Mayor asked if there was anyone present who would like to speak in regards to the street closing. There being none, the Mayor closed the public hearing. CONSIDER AN ORDINANCE TO CLOSE CHURCH STREET Councilmember Insell introduced an ordinance, which would vacate First, or Church Street. Mayor Biard read the ordinance and Councilmember Carpenter moved to suspend the rules and place the ordinance on the second reading. Councilmember Insell seconded and the roll call count was 8 for and 0 against. The Mayor read the ordinance for the second reading. Councilmember Insell moved to further suspend the rules and place the ordinance on the third and final reading. Councilmember Cargill seconded and the roll call count was 8 for and 0 against. The Mayor read the ordinance for the final reading and Councilmember Cargill moved to adopt the ordinance. Councilmember Carpenter seconded and the roll call count was 8 for and 0 against. The ordinance was given # 98-9-2. CONSIDER AN ORDINANCE TO WAVE THE COMPETITIVE BIDDING TO PURCHASE A FLAT BET TRUCK FOR THE SANITATION DEPARTMENT Mayor Biard read an ordinance that would wave the requirements of competitive bidding for the purchase of a flatbed truck with dump for the sanitation department. The Mayor said the city's current truck in a 1970 model and not safe to operate. The truck, which the city will purchase, is a 1987 International with a steel flat bed for$14,900.00. Councilmember Pectol moved to suspend the rules and place the ordinance on the second reading. Councilmember Bone seconded and the roll call count was 8 for and 0 against. The Mayor read the ordinance for the second reading and Councilmember Cargill moved to further suspend the rules and place the ordinance on the final reading. Councilmember Insell seconded and the roll call count was 8 for and 0 against. The Mayor read the ordinance for the third reading and Councilmember Insell moved to adopt the ordinance and Councilmember Cargill seconded. The roll call count was 8 for and 0 against. The ordinance was given # 98-9-3. Councilmember Cargill moved to adopt the emergency clause and Councilmember Insell seconded. The roll call count was 8 for and 0 against. There being no further business, Councilmember Mitchum moved that the meeting be adjourned and Councilmember Insell seconded. All voted for. JOE M. BIARD, MAYOR DENISE M. JOHNSTON, CITY CLERK
