MAY 25, 1999
The Batesville City Council met in regular session on May 25, 1999 at
5:30 P.M. at the Municipal Building. Mayor Joe Biard presided over the meeting.
Councilmember Cargill gave the invocation. Upon roll call, all the council
answered present except for Councilmember Gaither. Also present were the City
Clerk and the City Attorney.
Councilmember Ford moved that the minutes from the previous meeting
be approved. Councilmember Insell seconded and all voted for.
Councilmember Ford moved to approve the prepared agenda.
Councilmember Cargill seconded and all voted for.
RESOLUTION STATING THE PURPOSE AND INTENT FOR A MORATORIUM
ON CITY REGULATIONS IF VOTERS APPROVE AN ANNEXATION
PROPOSAL ON OCTOBER 12, 1999.
Mayor Biard read a resolution that states the purpose and intent for a
moratorium on city regulations if voters approve an annexation proposal on
October 12, 1999. Mayor Biard asked the group if they would like to discuss the
resolution before they give their presentation. Mr. Phillip Finch, spokesman for
the anti-annexation group, said they were not interested in the resolution,
therefore, Mayor Biard withdrew the resolution for consideration.
PUBLIC HEARING —ANNEXATION
Mayor Biard officially opened the public hearing to discuss the annexation
proposal to the City of Batesville. A group of citizens who are against annexation
addressed the council first. The Mayor then opened the floor for anyone who is
for annexation. The Mayor then closed the public hearing.
CONSIDER AN ORDINANCE TO CALL FOR A SPECIAL ELECTION TO
ANNEX CERTAIN LAND INTO THE CITY OF BATESVILLE — THIRD
READING
Councilmember Carpenter moved to put the ordinance on the third
reading. Councilmember Bone seconded and the roll call count was 7 for and 0
against. Mayor Biard read the ordinance. After a brief discussion
Councilmember Bone moved to adopt the ordinance and Councilmember
Carpenter seconded. The roll call count was 6 for (Pectol, Bone, Cargill,
Carpenter, Insell, and Mitchum) and 1 against (Ford). The ordinance passed and
was given #99-5-1.
PUBLIC HEARING ON VARIOUS PROPERTIES TO BE CONSIDERED FOR
CONDEMNATION
Mayor Biard opened the public hearing at 7:17 P.M. to consider the
condemnation of various properties within the city limits. The properties to be
considered are a structure on the 2300 Block of Byers Street, owner Ronald
Bennett, 2455 Neeley Street, owner State of Arkansas, 380 Lilly Street, owner
Dexter White, 763 State Street, owner Henry Clement and 332 E. Main Street,
owner Payton Landers. Mr. Henry Clement who owns the property at 763 State
Street addressed the council and said he was in poor health but hopes to fix the
house back up and move back into it. Mr. Clement said he would need at least
one year to repair the house. Mr. Clement promised the council that he would
keep the brush cut and the yard in good condition. Mr. McClure told Mr. Clement
that he would have 20 days to prove to the council that he is going to repair the
house before the council takes any action on the property. Mr. Dexter White,
owner of the property at 380 Lilly Street addressed the council. Mr. McClure said
Mr. White bought a demolition permit on May 5, 1999. Mr. White said he has
started tearing down the house starting with the roof. The council asked Mr.
White an approximate time frame for removal but he said he could not give a
definite answer. The council asked Mr. McClure to watch the progress and give
a report at the next meeting. The Mayor closed the public hearing.
FINANCIAL STATEMENT
The council was given a copy of the City's financial statement for the
month ending April 30, 1999.
CEMETERY RESOLUTIONS
The council considered two cemetery resolutions; Fred and Clara
Thomas, Resolution #99-145-1 for$400.00 and Fred and Veda Russell,
Resolution #99-145-2 for $400.00. The resolutions being in order,
Councilmember Insell moved to adopt the resolutions. Councilmember Bone
seconded and all voted for.
There being no further business, Councilmember Mitchum moved that the
meeting be adjourned. Councilmember Insell seconded and all voted for.
