JUNE 22, 1999
The Batesville City Council met for its regular meeting on June 22, at 5:30 P.M. at the
Municipal Building. Mayor Joe Biard presided over the meeting. Councilmember Insell gave the
invocation. Upon roll call, all the council answered present. Also present were the City Clerk
and the City Attorney.
Councilmember Ford moved to approve the minutes from the previous meeting.
Councilmember Cargill seconded and all voted for.
Councilmember Ford moved to approve the prepared agenda and Councilmember Cargill
seconded. All voted for.
KENNY SMITH: WATER DRAINAGE COMPLAINT
Mr. Kenny Smith addressed the council regarding water drainage on his property located
at 2450 Case Street. Mr. Smith showed the council a video after the flash flood the City had on
June 13. Mayor Biard said there are drainage problems all over the City. The Mayor said he
hopes to bring a proposal to the council within the next year to help the drainage problem in
Batesville. The Mayor said the City was going to do some work to the head wall near Mr.
Smith's house to help keep the street from washing away.
DISCUSSION OF COPS GRANT PROGRAM
The Mayor and City Clerk told the council that the City has been overpaid for the COPS
Grant. The Sheriff's Department requested the reimbursements for the City. Instead of
requesting 75% of the total expenses for the officers, the Sheriff's Department requested 100%.
Therefore, the City has collected in advance. The County has already reimbursed the COPS
Grant a total of$38,363.77. The City's portion is $22,657.77. The City should receive the total
amount of the grant in full by the end of this year. Councilmember Cargill moved to pay the
City's portion. Councilmember Gaither seconded and all voted for.
DISCUSSION OF LOCKKEEPER'S HOUSE AT RIVERSIDE PARK
The City received one bid on remodeling the Lockkeeper's House at Riverside Park. Mr.
Danny Dozier proposed to lease the property from the City for a period of 20 years with an
option to renew for an annual payment of$1,200.00. He will invest no less than $150,000 on
structural improvements to develop a restaurant. Mr. Dozier was present to explain his plans
and answer any questions from the council. The Mayor said the next step would be for Mr.
Dozier to have an architect draw plans for his proposal. The Mayor also recommended that Mr.
Dozier's attorney talk with the City Attorney to make a couple of changes in the proposal. Mr.
Insell asked if the City should have the property surveyed and re-zoned and all agreed that the
City should do so. Councilmember Bone moved to in principal support Mr. Dozier's proposal to
establish a restaurant at the Lockkeeper's House. Councilmember Pectol seconded and all
voted for.
APPOINTMENT TO PLANNING COMMISSION
Mayor asked the council to accept the appointment of Ms. Fran Flener to the planning
commission. Councilmember Mitchum so moved and Councilmember Carpenter seconded. All
voted for. Ms. Flener's term will be from 6/10/99 thru 6/10/2004
FINANCIAL REPORT
The council was given a copy of the financial statement for the month ending May 31,
1999.
COUNCIL COMMENTS
Councilmember Ford said a citizens in the Sawmill Addition gave him some pictures
showing the water drainage problems at his home. Again, the council discussed the drainage
problems within the City.
Councilmember Bone said she has had several complaints regarding the 3-way stop at
Dogwood, Jennings and Juniper. The citizens say that people do not stop at the intersection
and constantly litter there. Councilmember Carpenter said he has received the same calls. He
said they also complained about speeding in the area specifically on Mark Lane and Dogwood.
Mr. Carpenter said the citizens said they would help by using videotape of the speeding cars.
Mayor Biard said citizen involvement would be a great help. He also recommended that each
Councilmember write a letter to the Sheriff and ask for better patrolling in the City limits of
Batesville.
Councilmember Mitchum said he has received calls regarding "on street parking". Mr.
Mitchum said the problem stems from older homes that were built for only one automobile.
Most families today have more than one automobile. Mr. Mitchum said he did not know how to
solve the problem and asked that citizens drive careful where cars are parked along the side of
the streets.
There being no further business, Councilmember Mitchum moved that the meeting be
adjourned. Councilmember Insell seconded and all voted for.
