JULY 27, 1999
The Batesville City Council met in regular session on July 27, at 5:30 P.M.
at the Municipal Building. Mayor Joe Biard presided over the meeting. Upon roll
call all the council answered present. Also present were the City Clerk and the
City Attorney.
Councilmember Ford moved to approve the minutes from the previous
meeting. Councilmember Insell seconded and all voted for.
Councilmember Ford moved to approve the prepared agenda and
Councilmember Cargill seconded. All voted for.
CITIZENS COMMENT ON RESTROOM AT KENNEDY PARK
Mayor Biard said he had a complaint from a citizen regarding
inappropriate behavior at the restroom at Kennedy Park. Mayor Biard asked
Sheriff Webb to patrol the area at Kennedy Park for any inappropriate conduct at
the restroom. Sheriff Webb said that 4 arrests have been made recently for
disorderly conduct at that location.
Councilmember Insell asked the Mayor to call an Interlocal Meeting to
discuss, among other things, the shortage of sheriffs deputies for the county.
MAYOR'S ANNOUNCEMENTS
Mayor Biard said the investigation regarding a house that burned at 20th
and Maple Streets was complete. The house was under investigation for arson.
Fire Chief Davis said the property owner has hired an attorney to appeal the
denial from the insurance company. Mayor Biard asked Mr. McClure to contact
the homeowner and ask his intentions for the property and report back at the
August 10th meeting.
Mayor Biard said Batesville Furniture Gallery has offered to donate
approximately 20 acres along the Bayou to the City. The Mayor said they have
offered the land to the City if we would develop it within the next 3 to 5 years.
The Mayor said the City should be able to find a grant to help develop the area
into a possible biking trail and possibly a canoeing area. Councilmember Cargill
moved for the Mayor to accept the offer and go forward with searching for a grant
to develop the property. Councilmember Carpenter seconded and all voted for.
FINANCIAL STATEMENT
The council was given a copy of the financial statement for the month
ending June 30, 1999.
CONSIDER AN ORDINANCE TO INCREASE THE NUMBER OF PLANNING
COMMISSION MEMBERS FROM 5 TO 7
Mayor Biard read an ordinance that would increase the number of
Planning Commission Members from 5 to 7. Councilmember Bone moved to
suspend the rules and place the ordinance on the second reading.
Councilmember Carpenter seconded and the roll call count was 8 for and 0
against. The Mayor read the ordinance for the second reading. Councilmember
Cargill moved to further suspend the rules and place the ordinance on the final
reading. Councilmember Carpenter seconded and the roll call count was 8 for
and 0 against. The Mayor read the ordinance for the third and final reading.
Councilmember Bone moved to adopt the ordinance and Councilmember
Carpenter seconded. The roll call count was 8 for and 0 against. The ordinance
was given No. 99-7-2. Councilmember Carpenter moved to adopt the
emergency clause. Councilmember Cargill seconded and all voted for.
COUNCIL COMMENTS
Councilmember Bone asked the Mayor to check into drafting a sign
ordinance to limit large billboards and signs in the City limits of Batesville. Mayor
Biard said we have a few samples from other cities and will try to have an
ordinance to consider within the next month.
There being no further business, Councilmember Mitchum moved that the
meeting be adjourned. Councilmember Insell seconded and all voted for.
