HomeMy WebLinkAbout1999-09-14 MINUTES OF COUNCIL SEPTEMBER 14, 1999 The Batesville City Council met for its regular meeting on September 14, at 5:30 P.M. at the Municipal Building. Mayor Joe Biard presided over the meeting. Councilmember Ford gave the invocation. Upon roll call, all the council answered present. Also present were the City Clerk and the City Attorney. Councilmember Ford moved to approve the minutes from the previous meeting. Councilmember Pectol seconded and all voted for. Councilmember Ford moved to approve the prepared agenda and Councilmember Insell seconded. All voted for. CONSIDER AN ORDINANCE TO RE-ZONE CERTAIN PROPERTY LOCATED NEAR HIGHWAY 69 EAST FOR THE DEPARTMENT OF HUMAN SERVICES FROM R-1 TO C-2 Mayor Biard read an ordinance that would re-zone certain property of Independence County from R-1 Residential to C-2 Commercial. The property is located on Highway 69 East and is owned by Independence County. Councilmember Insell moved to suspend the rules and place the ordinance on the second reading. Councilmember Carpenter seconded and the roll call count was 8 for and 0 against. The Mayor read the ordinance for the second reading and Councilmember Bone moved to further suspend the rules and place the ordinance on the third reading. Councilmember Cargill seconded and the roll call count was 8 for and 0 against. The Mayor read the ordinance for the final reading and Councilmember Gaither moved to adopt the ordinance. Councilmember Cargill seconded and the roll call count was 8 for and 0 against. The ordinance was given number 99-9-1. Councilmember Bone moved to adopt the emergency clause. Councilmember Insell seconded and all voted for. AS REQUESTED, COMMENTS REGARDING RACE RELATIONS Mayor Biard opened the floor for discussion regarding race relations in Batesville. Mr. Cecil Sherrill, a member of the black community, said that there were no problems in the City of Batesville between the white and black communities. Mr. Sherrill was the only member of the audience who addressed the council. DISCUSSION REGARDING ADDITIONAL CUT IN BOULEVARD SECTION IN EAGLE MOUNTAIN Dr. Brad Griffin addressed the council and presented a drawing of the proposed cut in the boulevard on Eagle Mountain Boulevard. Councilmember Bone moved to allow Dr. Griffin to make the cut and Councilmember Pectol seconded. All voted for. CONSIDER A RESOLUTION TO APPLY FOR A GRANT TO CONSTRUCT A CHILD CARE CENTER Mayor Biard read a resolution authorizing the Mayor of Batesville to submit an application to the Arkansas Department of Economic Development for a child care center project. The child care center will be constructed at the Kindergarten Center on Lyon Street and operated by the Batesville School District. Councilmember Bone moved to adopt the resolution and Councilmember Cargill seconded. All voted for. The resolution was given #99-9-1. REQUEST BY THE VANEMBURG ESTATE FOR AN EASEMENT ON WEST RICH STREET IN WEST BATESVILLE The council considered a request for heirs of the Oscar Neil Vanemburg Estate for an easement on West Rich Street in Batesville. Councilmember Cargill moved to approve the easement request and Councilmember Insell seconded. All voted for. DISCUSSION ON TRUCKS USING 20TH STREET AS THRU TRAFFIC Since the stoplight has been put in at Harrison and 20th Streets heavy trucks have been using Myers and 20th Streets as a truck route. Mayor Biard said he would like to put signs beginning at Sidney Street at Myers to read "No Through Heavy Truck Traffic". Councilmember Cargill moved to place the signs and Councilmember Gaither seconded. All voted for. COUNCILMEMBER OPINIONS ON KEEPING FORMER RADIO STATION BUILDING AT RIVERSIDE PARK OR TEARING IT DOWN The council discussed the fact that the use of the old radio station building is restricted under the guidelines of the grant the city acquired to purchase the property. The council decided to wait to make a decision on whether to tear down the building. OPINIONS ON RETAINING CITY PARKING LOT ON FOURTH STREET Councilmember Gaither moved to stop the lease agreement on the Fourth Street parking lot. Councilmember Pectol seconded and all voted for. REVIEW BILLS After a review of the bills, Councilmember Insell moved to pay the bills and Councilmember Gaither seconded. All voted for. CEMETERY RESOLUTION The council considered a cemetery resolution number 99-257-1, for$300.00 for Alfred Barnett. Councilmember Insell moved accept the resolution and Councilmember Gaither seconded. All voted for. COUNCIL COMMENTS There being no further business, Councilmember Mitchum moved that the meeting be adjourned. Councilmember Gaither seconded and all voted for. JOE M.
