JUNE 12,2001
The Batesville City Council met in regular session on June 12,at 5:30 PM at the
Municipal Building. Mayor Joe Biard presided over the meeting. Councilmember Ford gave the
invocation. Upon roll call the following Councilmembers answered present: Dana Bone,Jim
Cargill,R.L.Carpenter,Robert Ford,Gerald Gaither,Jim Mitchum,Jerry Pectol and Jim
Watkins. Also present were the City Clerk Denise Johnston and the City Attorney Scott Stalker.
Councilmember Ford moved to approve the minutes from the last meeting.
Councilmember Pectol seconded and all voted for.
Councilmember Ford moved to approve the prepared agenda as amended.
Councilmember Cargill seconded and all voted for.
REPORT FROM SHERIFF DAN JOHNSON
Sheriff Dan Johnson gave the council a monthly Departmental Activity and Status
Report.
RESOLUTION TO ENTER INTO A CONTRACT FOR A NEW CHILDCARE
FACILITY
Mr.Van Thomas from White River Planning and Development District,Inc.was present
to answer any questions that the council may have regarding a resolution that would authorize
the Mayor and City Clerk to enter into a contract with Oakwood Construction,Inc.of Beebe,
Arkansas for the construction on a child care facility. The bid was for$191,665. The facility
will be constructed at the Kindergarten Center. The Mayor read the resolution and
Councilmember Bone moved that it be adopted. Councilmember Watkins seconded and all
voted for. The resolution was given#2001-6-1-R.
DISCUSSION WITH THE WATER CARNIVAL COMMITTEE CONCERNING
ACTIVITIES AT RIVERSIDE PARK THIS YEAR
A group from the White River Water Carnival Committee addressed the council about
moving pieces of playground equipment from its current location down to the old radio station
property. The committee said by opening up the area where the playground equipment currently
is you could seat about 1,500 to 2,000 more people for concerts. The council had several
concerns. One concern was placing the playground equipment that is meant for older children
next to the equipment meant for younger children. Also the lack of shade trees was a concern.
After a discussion,the council gave the committee permission to move the equipment at no
expense to the City. The committee also said if the citizens did not like the relocation,they
would put the playground equipment back to its original location.
REPORT FROM CARL PINKSTON ON CONDEMNED PROPERTY AT 2455 NEELEY
STREET
Mr.Carl Pinkston addressed the council about the property located at 2455 Neeley Street.
Mr.Pinkston said the property belongs to his son who is in active duty in the service. Code
Enforcement Officer Chad McClure showed the council several pictures of the house on the
property. After a discussion,Councilmember Cargill moved to proceed with the condemnation
and tear down the structure. Councilmember Carpenter seconded and all voted for. Mayor Biard
asked Mr.Pinkston to supply Mr.McClure with an address for his son so the City can notify him
on the council's decision.
CONSIDER AN ORDINANCE AMENDING SECTION XI OF THE CITY OF
BATESVILLE'S ZONING CODE RELATING TO OFF STREET PARKING,LOADING
AND LANDSCAPING
Councilmember Bone introduced an ordinance that that would amend Section XI of the
City's Zoning Code. The amendment is related to off street parking,loading and landscaping.
Mayor Biard read the ordinance in full. After a discussion and a couple of recommended
changes,the Mayor said the ordinance would be placed on the agenda for the next meeting for
the second reading.
CONSIDER AN ORDINANCE AMENDING THE CITY OF BATESVILLE'S ZONING
CODE CONCERNING HISTORICAL DISTRICTS
Councilmember Mitchum introduced an ordinance that would change the City's zoning
code concerning historical districts. The Mayor read the ordinance in full and opened the floor
for discussion. After a discussion,the Mayor said the ordinance would be placed on the next
agenda for the second reading.
THREE PUBLIC HEARINGS TO CONSIDER CONDEMNATION OF THREE
PARCELS OF PROPERTY
The council considered three properties for condemnation. 1) 1108 15th Street,owned by
Mrs.Gerdy Cason. Councilmember Watkins moved to proceed with condemnation procedures.
Councilmember Pectol seconded and all vote foi. 2)Corner of 5d'&Vine Streets,owned by
Doug and Mike Brodie. Mr.Butch Ketz was present to represent the family and asked for
additional time to bring the property up to meet code. Mr.Ketz asked for 60 days. The council
agreed to grant the additional time.13)_1500 Block off Case Street,owned by Ancient Free and -- commented[DMJ1]:Brodie Property
Accepted Mason of America. Councilmember Watkins moved to proceed with the
condemnation proceedings. Councilmember Cargill seconded and all voted for.
THIRD READING OF ZONING CODE,SECTION VIII
Mayor Biard read the proposed amendment to the zoning code to include a T-1
Traditional Business District. This was the third reading of the ordinance. Councilmember
moved to adopt the ordinance and Councilmember seconded. The roll call count was 6 for
(Watkins,Bone,Cargill,Ford,Gaither,Mitchum)2 against(Carpenter and Pectol). The
ordinance was given#2001-6-1.
CONSIDER AN APPOINTMENT TO THE BATESVILLE HOUSING AUTHORITY
Mayor Biard recommended a re-appointment of Mr.Bud Kerr to the Batesville Housing
Authority. Councilmember Ford so moved and Councilmember Gaither seconded. All voted
for. Mr.Kerr's new term will run 5/27/01 thru 5/27/06.
There being no further business,Councilmember Mitchum moved that the meeting be
adjourned. Councilmember Ford seconded and all voted for.
