AUGUST 14, 2001
The Batesville City Council met in regular session on August 14, at 5:30 PM at
the Municipal Building. Mayor Joe Biard presided over the meeting. Councilmember
Ford gave the invocation. Upon roll call the following Councilmembers answered
present: Dana Bone, Jim Cargill, R.L. Carpenter, Robert Ford, Gerald Gaither, Jim
Mitchum, Jerry Pectol and Jim Watkins. Also present were the City Clerk Denise
Johnston and the City Attorney Scott Stalker.
Councilmember Ford moved to approve the minutes from the last meeting.
Councilmember Cargill seconded and all voted for.
Councilmember Ford moved to approve the prepared agenda. Councilmember
Gaither seconded and all voted for.
SHERIFF'S REPORT
Sheriff Dan Johnson gave the council the Departmental Activity and Status
Report for July, 2001.
CONSIDERATION OF ANNEXING UACCB PROPERTY BY PETITION
Councilmember Ford introduced an ordinance that would accept the annexation of
certain land belonging to the University of Arkansas Community College at Batesville to
the City of Batesville. Dr. Jack Lassiter, Chancellor of UACCB was present to answer
questions from the council. The proposed property consists of 25.14 acres and attaches to
the east border of the original campus. Mayor Biard read the ordinance for the first
reading. A full property description was included in the ordinance. Councilmember Ford
moved to suspend the rules and place the ordinance on the second reading.
Councilmember Bone seconded and the roll call count was 8 for and 0 against. The
Mayor read the ordinance for the second reading and Councilmember Ford moved to
further suspend the rules and place the ordinance on the third reading. Councilmember
Bone seconded and the roll call count was 8 for and 0 against. The Mayor read the
ordinance for the final reading and Councilmember Ford moved to adopt the ordinance.
Councilmember Bone seconded and the roll call count was 8 for and 0 against. The
ordinance was given number 2001-8-1.
CONSIDER AN ORDINANCE TO AMEND THE 2001 BUDGET
Mayor Biard read an ordinance that would amend the 2001 budget.
Councilmember Watkins moved to suspend the rules and place the ordinance on the
second reading. Councilmember Cargill seconded and the roll call count was 8 for and 0
against. The Mayor read the ordinance for the second reading and Councilmember Ford
moved to further suspend rules and place the ordinance on the final reading.
Councilmember Watkins seconded and the roll call count was 8 for and 0 against. The
Mayor read the ordinance for the third and final reading and Councilmember Ford moved
to adopt the ordinance. Councilmember Cargill seconded and the roll call count was 8
for and 0 against. The ordinance was given number 2001-8-2
FINAL CONSIDERATION FO DEMOLITION CONDEMNED PROPERTIES
Code Enforcement Officer Chad McClure showed the council pictures of two
properties that the council has previously condemned and asking for the abatement of the
properties. The properties are located at 15th and Bates Streets, 14th and Case Streets.
Councilmember Watkins moved to abate the properties and Councilmember Pectol
seconded. All voted for.
Mr. McClure showed the council pictures of several additional properties that
need to be condemned. Mr. McClure said he has been working on these properties for a
long time, locating the owners and trying to get them to clean up and repair the structures.
The properties are located at 828 Vine, 1388 Lyon, Hwy 25 and County Yard Road, 1712
No. Central Ave, and 180 Craig Street. Mr. McClure also discussed Imperial Motors
located on East Main. He said the property qualifies as a junkyard which is not allowed
in C-2. Councilmember Carpenter moved to proceed with condemnation on the above
properties and enforce the zone on the Imperial Motors property. Councilmember
Gaither seconded and all voted for.
PAID BILLS REPORT
The council was given a copy of the paid bills report for July 31, 2001
MAYOR'S ANNOUNCEMENTS
The Mayor announced the annual Interlocal meeting has been set for September
13.
COUNCIL COMMENTS
Councilmember Bone asked the City Attorney to look at the current zoning codes
and come to the council with a recommendation on how the zone could be changed to
make property owners responsible for the upkeep of their abandoned properties.
There being no further business, Councilmember Mitchum moved that the
meeting be adjourned. Councilmember Gaither seconded and all voted for.
