OCTOBER 11, 2016
The Batesville City Council met in regular session on October 11, at 5:30 pm at
the Municipal Building. Mayor Rick Elumbaugh presided over the meeting. Utility Billing
Supervisor Nick Baxter gave the invocation. Upon roll call, the following
Councilmembers answered present; Chris Beller, Tommy Bryant, Sonya Crafton,
Margaret Henley, Doug Matthews, Chris Poole and David Shetron. Also present were
the City Clerk Denise Johnston and City Attorney Tim Meitzen. Councilmember Paige
Hubbard was absent.
Councilmember Bryant moved to approve the minutes from the previous
meeting. Councilmember Shetron seconded and all voted for.

NEW BUSINESS
A) POLICE DEPARTMENT REPORT
Police Chief Alan Cockrill addressed the council with his monthly report for
September. The Chief gave the council a report for the month which included 41
accidents worked by our officers. Chief Cockrill told the council that the City has
been approved for a Department of Justice grant, a federal grant, for bullet proof
vests. The approved amount is $15,000.00 and is a 50% reimbursable grant.
He also announced that Prosecuting Attorney Don McSpadden is donating
$10,080.00 to purchase 12 bullet proof vests to the Batesville PD. The vests
were ordered yesterday. He said all the current vests that are still "in date" will
be passed down to the reserve officers.
B) ENGINEER'S REPORT
City Engineer Damon Johnson addressed the council with his monthly report.
Mr. Johnson updated the council on the line replacement projects in West and
East Batesville. He said the Street Department was working on "standing water'
issues at Riverside Park. Mr. Johnson said both treatment plants were running
as usual.
C) CONSIDER A RESOLUTION TO REVISE THE CITY'S COMPREHENSIVE PLAN
Councilmember Bryant introduced a resolution to revise the City's
Comprehensive Plan. Code Enforcement Officer Chad McClure addressed the
council to answer questions from the council. Mr. McClure said Mr.'s Brandon
Holmes and Zach Mobley are requesting the rezone from R-1 to R-2. The
property is located west of Big Pine Road and will be used for single level, brick
style condominiums with garages. Mr. McClure said a "pre-meeting" with the
surrounding land owners was conducted before the Public Hearing to answer any
concerns the land owners may have. He said everyone in the pre-meeting was
satisfied with the request. One land owner, who was not able to make the pre-
meeting, said at the Public Hearing that she was concerned with the additional
traffic flow on Big Pine Road. Mr. McClure said the only entrance to the
proposed condos will be off Big Pine Road, but after visiting with the land owner,
she had no further concerns. Mr. Meitzen read the resolution in full.
Councilmember Bryant moved to adopt the resolution and Councilmember Beller
seconded. The electronic roll call count was 7 for and 0 against. The resolution
was given #216-10-01-R.
D) CONSIDER AN ORDINANCE TO AMEND THE CITY'S ZONING DISTRICT MAP
Councilmember Shetron introduced an ordinance to amend the Batesville Zoning
District Map to change property located on Big Pine Road from R-1 to R-2.
Councilmember Matthews moved to suspend the rules and read the ordinance
by title only. Councilmember Bryant seconded and the electronic roll call count
was 7 to 0. Mr. Meitzen read the ordinance by title only. Councilmember
Matthews further moved to suspend the rules and waive the second and third
readings. Councilmember Shetron seconded and the electronic roll call count
was 7 for and 0 against. Councilmember Matthews moved to adopt the
ordinance and Councilmember Shetron seconded. The electronic roll call count
was 7 for and 0 against. The ordinance was given #2016-10-01.
E) CONSIDER THE LEVY OF TAXES FOR THE YEAR 2016, PAYABLE IN 2017
The council considered the levying of taxes for the year 2016, payable in 2017.
Councilmember Bryant moved to approve the levy of taxes at the same rate as
the past several years, 5 Mills for the City General and .4 Mills for the Firemen's
Pension Fund. Councilmember Henley seconded and the electronic roll call
count was 7 for and 0 against.
F) REVIEW OF THE PAID BILLS REPORT
The council was given a copy of the September, 2016 paid bills report for review.
FIXED ASSETS DISPOSALS
City Clerk Denise Johnston informed the council of several fixed assets
disposals. Fire Department, 2004 Freightliner Brush Truck, Unit#620, returned to the
Arkansas Forestry Commission. Sanitation, 1994 Garbage truck, Unit#265, sold on
GovDeals for$2,687.50. Utility Construction, 1998 John Deere Gator, Unit#C497 and
a 2004 F-350 truck, Unit#C410, sold on GovDeals for $1,881.25 and $7,256.25,
respectively. Street Department, 1987 Ford Vacon, Unit 760, sold on GovDeals for
$6,665.00, 1999 Dodge truck, Unit#700, sold on GovDeals for $752.50, Bush Hog, sold
on GovDeals for $752.50, 1974 Ford one ton, Unit#717, sold on GovDeals for
$1,183.57, 1994 bucket truck, Unit#736, sold on GovDeals for $2,472.50, 1984 Chev.,
Unit#730, sold on GovDeals for$591.25.
MAYOR COMMENTS
Mayor Elumbaugh invited the council and public to a ribbon cutting at the Mark
Edward House expansion at Kennedy Park, Friday at 11:00 AM.
LIAISON REPORTS
None
COUNCIL COMMENTS
Councilmember Bryant said he has had a request to place a stop sign at
Ridgecrest and Crestview Drive. Mr. Bryant said he and the Mayor had looked at the
intersection and because of the complexity of the intersection, they both agree that a
stop sign should be placed on Crestview Drive. Mr. Bryant moved to place the stop sign
and Councilmember Matthews seconded. All voted for.
Councilmember Henley said she had received several comments about the new
street striping around town. Those who have contacted her were pleased with the new
striping.
ADJOURNMENT
There being no further business, Councilmember Matthews moved that the
meeting be adjourned. Councilmember Bryant seconded and all voted for.
