MARCH 26, 2002
The Batesville City Council met in regular session on March 26, at 5:30 PM at the Municipal
Building. Mayor Joe Biard presided over the meeting. Councilmember Ford gave the invocation. Upon roll
call the following Councilmembers answered present: Jim Cargill, R.L. Carpenter, Robert Ford, Gerald
Gaither, Jim Mitchum, Jerry Pectol and Jim Watkins. Also present were the City Clerk Denise Johnston and
the City Attorney Scott Stalker.
Councilmember Ford moved to approve the minutes from the last meeting. Councilmember Cargill
seconded and all voted for.
Councilmember Ford moved to approve the prepared agenda as amended. Councilmember Watkins
seconded and all voted for.
NOMINATIONS FOR CITY COUNCIL, WARD #1, POSITION #1
Mayor Biard opened the floor for discussion regarding the appointment of a Councilmember to
represent Ward#l, Position#l. The Mayor said there were a few options that the council could take. As of
this afternoon, two people have filed for the position as democrats. The Mayor said if the council so desired,
they could postpone the appointment until after the May primary and let the people decide. There will be 3
council meetings between now and the May primary. Secondly, they could go ahead and do the nominations
tonight or thirdly they could table the nominations until the next meeting to have time to consider their
options. After a discussion, Councilmember Watkins moved to wait until after the May primaries to make an
appointment to the council position. Councilmember Cargill seconded and all voted for.
UPDATE ON BATESVILLE RIVERWALK
Mr. Herman Lee with Lee and Associates Architects gave the council a copy of some drawings for
the Batesville Riverwalk Mr. Lee said the work should begin soon and the contractors have been given 6
months to complete the project.
AIRPORT COMMISSION REPORT
Airport Commissioners Steve Bryant and Bob Carter addressed the council and gave them a list of
completed projects in 2001 and a list of future capital improvement needs.
CODE ENFORCEMENT: PUBLIC HEARING TO BEGIN PLACEMENT OF LIENS ON
PROPERTY FOR THE CONDEMNATION AND REMOVAL OF HOUSES AND THE CLEANING
OFF OF A VACANT LOT
The Mayor opened the public hearing to begin the placement of liens on these listed properties: 2455
Neeley Street, 1108 15th Street and 528 Wycough Street. There being no one in the audience wishing to
address the properties, the Mayor closed the public hearing. Mr. McClure said the cost to tear down the
structures at 2455 Neeley and 1108 15th was $2,000.00 each plus the cost of the publications of the public
hearing notices. Councilmember Gaither moved to proceed with the placement of liens on the Neeley and
15th Street properties. Councilmember Pectol seconded and all voted for. The Mayor said Mr. McClure was
trying to locate Ms. Geneva Barlow regarding her property at 528 Wycough. The Mayor said if they locate
Ms. Barlow they will offer to forgo the $350.00 clean up fee of her property if she will continue to keep it
cleaned up. The council agreed with the Mayor's proposal.
FINANCIAL STATEMENT
The council was given the financial statement for the month ending February 28, 2002.
MAYOR'S ANNOUNCEMENTS
Mayor Biard told the council he would like to appoint a committee of three Councilmembers to
consider the applications for animal control. Councilmembers Gaither, Watkins and Mitchum accepted the
appointment.
There being no further business, Councilmember Mitchum moved that the meeting be adjourned.
Councilmember Gaither seconded and all voted for.
