HomeMy WebLinkAbout2002-05-14 MINUTES OF COUNCIL MAY 14, 2002 The Batesville City Council met in regular session on May 14, at 5:30 PM at the Municipal Building. Mayor Joe Biard presided over the meeting. Councilmember Watkins gave the invocation. Upon roll call the following Councilmembers answered present: Jim Cargill, R.L. Carpenter, Robert Ford, Jim Mitchum, Jerry Pectol and Jim Watkins. Councilmember Gaither was absent. Also present were the City Clerk Denise Johnston and the City Attorney Scott Stalker. Councilmember Ford moved to approve the minutes from the last meeting. Councilmember Pectol seconded and all voted for. Councilmember Ford moved to approve the prepared agenda as amended. Councilmember Pectol seconded and all voted for. SHERIFF'S MONTHLY REPORT Sheriff Dan Johnson gave his monthly report to the council. CONSIDERATION OF DRAFTING AN ORDINANCE RELATING TO LOUD NOISES Mayor Biard told the council he had included in their packets another ordinance from a town in Arkansas to look at for drafting a noise ordinance. The council was in agreement that they need more time to look at the ordinances presented to them. They also asked the city attorney to get them a copy of the current State Law regarding noise and some case laws to look at. Mrs. Jim Burnett addressed the council and read a prepared statement regarding the noise at Riverside Park. Mrs. Burnett ended her statement with she felt like it was time to stop making excuses and find a way to solve the problem. CONSIDER AN ORDINANCE TO RE-ZONE CERTAIN PROPERTY FROM R-2 TO C-1 Councilmember Ford introduced an Mayor Biard read an ordinance that would re-zone certain property owned by Mrs. Leonard Yost, U.F.O., Inc., Gerald Lewis, J.D. Holder, Chris Martin, City of Batesville, W.L.T., Inc., Richard Dahlquist, Paul Holland, and Paulene Wolford from R-2 to C-1. The property description is all of block 80 of the Maxfields 3rd Eastern Addition and all of Block 3 of the Grays Addition (the corner of Sidney and Lawrence Streets). Councilmember Cargill moved to suspend the rules and place the ordinance on the second reading. Councilmember Watkins seconded and the roll call count was 6 for and 0 against. The Mayor read the ordinance for the second reading and Councilmember Cargill moved to further suspend the rules and place the it on the third reading. Councilmember Watkins seconded and the roll count was 6 for and 0 against. The Mayor read the ordinance for the final reading and Councilmember Ford moved to adopt the ordinance. Councilmember Cargill seconded and the roll call count was 6 for and 0 against. The ordinance was given No. 2002-5-1. Councilmember Cargill moved to adopt the emergency clause and Councilmember seconded. The roll call count was 6 for and 0 against. CONSIDER RECOMMENDATIONS FOR CONDEMNATION FOR CERTAIN PROPERTIES IN BATESVILLE Code Enforcement Officer Chad McClure showed the council several pieces of properties that are currently under condemnation or to be considered for condemnation. Property located at 180 Craig Street was condemned on October 2, 2001. Mr. McClure said the low bid for tearing down the structure and cleaning up the property was around $2,000.00. Councilmember Cargill asked the Mayor to contact the County and see if they could use their equipment to remove the structure and clean it up for less than the bids received by the City. The Mayor said he would contact the County. Councilmember Watkins moved to proceed with tearing down the structure and Councilmember Carpenter seconded. All voted for. The second property is located at 10th and Oak Streets. The property is owned by Mr. Larry Little. Councilmember Cargill moved to begin the condemnation proceedings and Councilmember Watkins seconded. All voted for. The next property is located at 828 Vine Street. The property, owned by Mr. Ernest McNally who is now deceased, was condemned last year. The structure was torn down but the foundation is still there as well lots of debris and trash. Councilmember Watkins moved to have Mr. McClure research who the heir is to the property and notify them that the property needs to be cleaned up. Councilmember Cargill seconded and all voted for. The last property is located at 1830 Pickens. The owner of the property, Willie Sisk, is now deceased. The son of the owner is Dickie Sisk. The council asked Mr. McClure to contact Dickie Sisk and ask him to have the property cleaned up. CONSIDER PAY FOR ROCK DAMAGE TO AN AUTOMOBILE Mayor Biard said that a rock thrown from a mower at the cemetery damaged a vehicle parked at a dentist's office. The 2002 Cadillac is owned by Mary Woodsmall. The low bid for the repair was $385.93. Councilmember Watkins moved to pay for the repair and Councilmember Cargill seconded. All voted for.
