HomeMy WebLinkAbout2002-07-23 MINUTES OF COUNCIL JULY 23, 2002 The Batesville City Council met in regular session on July 23, at 5:30 PM at the Municipal Building. Mayor Joe Biard presided over the meeting. Councilmember Ford gave the invocation. Upon roll call the following Councilmembers answered present: Jim Cargill, R.L. Carpenter, Robert Ford, Gerald Gaither, Jim Mitchum, Paula Terrell and Jim Watkins. Councilmember Pectol was absent. Also present were the City Clerk Denise Johnston and the City Attorney Scott Stalker. Councilmember Ford moved to approve the minutes from the last meeting. Councilmember Watkins seconded and all voted for. Councilmember Cargill moved to approve the prepared agenda. Councilmember Ford seconded and all voted for. UTILITIES REQUEST FOR OUTSIDE CITY WATER AND SEWER CONNECTIONS Water Utility Manager Larry Tharnish and Mr. Jim Whitson addressed the council with requests to connect water and sewer outside the city limits. One request is for a water connection west of Davis Lane for Dusty Kelley. Mr. Kelley said he was going to petition the City to be annexed into the City. Councilmember Watkins moved to approve the request and Councilmember Terrell seconded. All voted for. The second request is for a sewer connection for Ms. Janette Meyer off Spring Valley Drive. The connection will run off the line that was run to the Industrial Park. Councilmember Watkins moved to approve the connection and Councilmember Cargill seconded. All voted for. CODE ENFORCEMENT UPDATES Code Enforcement Officer Chad McClure addressed the council with current code enforcement updates. He updated the council on the statues of the property located behind 440 Calvin Circle in Meadow Heights. Mr. Roger Crawford who lives on Calvin Circle showed the council a video that he took of the property and the conditions that he has to live by. There was a hole about approximately 6 foot deep full of stagnant water. The property also is grown up with high weeds and piles of brush. Mr. McClure read City Ordinance 493-11-2 which prohibits such conditions in the City limits. Councilmember Gaither moved to mow and clean up the property and to write citations to the property owners for unsightly property. Councilmember Watkins seconded and all voted for. Mr. Larry Little showed the council before and after pictures of his property located on the N/E corner of 9th and Oak Streets. The council condemned the property at a previous meeting. Mr. Little has made great improvements to the property. Councilmember Watkins moved to extend the time to have the property cleaned up for 30 more days. Councilmember Carpenter seconded and all voted for. DISCUSSION CONCERNING RIVERSIDE PARK Mayor Biard asked the council to approve the naming of the children's park at Riverside Park. The Mayor recommended "Riverside Children's Park and Memorial". He also asked for the council's approval of making the street that circles in front of the children's playground a one-way street. Councilmember Mitchum so moved and Councilmember Ford seconded. All voted for. Mayor Biard said signs stating restrictions and hours would also be posted. The council then discussed the recent vandalism that occurred at Riverside Park. Mr. Herman Lee and Max Eddy, a construction worker on the new riverwalk, addressed the council. Mr. Lee explained to the council why he felt the recent damage to the Outlook 41 was vandalism Mr. Eddy told the council of a couple of incidents regarding threats made by teenagers at the park to himself and to other co-workers. Sheriff Johnson and Captain Lindsey also addressed the council with possible solutions. After a discussion, the council instructed the City Attorney to draft an ordinance to address the parking at Riverside and Kennedy Parks and to impose fines for those parking sporadically within the parks. They also discussed have more visible policing of the parks. EXECUTIVE SESSION Councilmember Gaither moved to go into executive session. Councilmember Ford seconded and all voted for. Upon returning from executive session, Councilmember Watkins moved to re- appoint Mr. Tommy Tucker to the Parks Commission. Councilmember Cargill seconded and all voted for. Mr. Tucker's term will extend to May 10, 2007. FINANCIAL STATEMENTS The council was given a copy of the financial statements for June 30, 2002.
