HomeMy WebLinkAbout2002-08-13 MINUTES OF COUNCIL AUGUST 13, 2002 The Batesville City Council met in regular session on August 13, at 5:30 PM at the Municipal Building. Mayor Joe Biard presided over the meeting. Councilmember Watkins gave the invocation. Upon roll call the following Councilmembers answered present: Jim Cargill, R.L. Carpenter, Robert Ford, Gerald Gaither, Jim Mitchum, Jerry Pectol, Paula Terrell and Jim Watkins. Also present were the City Clerk Denise Johnston and the City Attorney Scott Stalker. Councilmember Ford moved to approve the minutes from the last meeting. Councilmember Pectol seconded and all voted for. Councilmember Ford moved to approve the prepared agenda as amended. Councilmember Watkins seconded and all voted for. PRESENTATION TO FIRE CHIEF BOB DAVIS Mayor Biard presented a plaque to retiring Fire Chief Bob Davis. Chief Davis will be retiring on August 21, 2002 at which time he will have worked with the Fire Department for over 28 years. SHERIFF'S MONTHLY REPORT Sheriff Dan Johnson gave the council a monthly activity and status report for July 2002. PARKS GRANT RESOLUTION Mayor Biard read a resolution authorizing the Mayor to submit an application to the Department of Parks and Tourism for a 50150 matching grant. The Mayor said the application will be to construct an amphitheater. Councilmember Cargill moved to adopt the resolution and Councilmember Gaither seconded. All voted for and the resolution was given 42002-8-1-R. CODE ENFORCEMENT ISSUES Mayor Biard opened the public hearing to consider condemnation of the structure located at 1830 Pickens Street. Mr. Dickey Sisk addressed the council and said he was in the process of tearing down the structure but need more than the 30 days to have it completed. The council explained to Mr. Sisk that at the end of the 30 days the council has the discretion to extend the time for completion. The Mayor closed the public hearing and read a resolution that would condemn the property at 1830 Pickens Street. Councilmember Watkins moved to adopt the resolution and Councilmember Terrell seconded. All voted for. The resolution was given 42002-8-2-R. The Mayor opened the public hearing to consider condemnation of the structure located at 1255 Davis Lane. Kenneth & Sharon Holmes, owners of the property were present. They told the council that they had a contract to sell the property to Tommy Harper, however, Mr. Harper was behind on the payments. Mrs. Holmes said they had contacted two business regarding tearing down the structure and were waiting on a third business. The Mayor closed the public hearing and the Mayor read the resolution to condemn the property at 1255 Davis Lane. Councilmember Watkins moved to adopt the resolution and Councilmember Gaither seconded. All voted for. The resolution was given 42002-8-3-R. The Mayor opened the public hearing to consider condemnation of the structure located at 2598 Case Street. The property is owned by Jerry Waugh and Bradley Cooper. Mr. Jim Noordhoek addressed the council and said he was trying to purchase the property. Mr. Noordhoek said he wants to tear down the existing structure and build a new home. He is going before the Planning Commission on September 9 to ask for a variance to build a house on the property. The property size is too small to build a house on according to the current zoning code. The Mayor closed the public hearing. The council decided to table the resolution to condemn the property at 2598 Case to give Mr. Noordhoek time to see if he can get financing to purchase the property and get a variance from the Planning Commission before proceeding with the condemnation. Mayor Biard open the public hearing to establish a lien amount for the property located at 1165 Arch Street. The City mowed the property on May 31, 2001 and therefore a lien to recuperate the cost for mowing was considered. Councilmember Gaither moved to place a lien on the property located at 1165 Arch Street in the amount of$350.00 for mowing plus advertising costs and 10% collection fee. Councilmember Watkins seconded and all voted for. Councilmember Cargill moved for Mr. McClure to go through the proper channels to notify the owners of the property at 1165 Arch again about mowing the property and if he gets no response have the city go in and mow it again this year. Councilmember Carpenter seconded and all voted for. Councilmember Watkins moved for the Mayor to send a letter to District Judge John Greg and ask him to stop granting extensions for two code enforcement cases that are pending in his court. Councilmember Carpenter seconded and all voted for. MAYOR'S ANNOUNCEMENTS Mayor Biard said the annual Interlocal Agreement Meeting is set for September 12, 2002 at 3:00 pm at the Municipal Building. PAID BILLS REPORT The council was given a copy of the paid bills report for the month ending July 2002. There being no further business, Councilmember Mitchum moved that the meeting be adjourned.
