SEPTEMBER 24, 2002
The Batesville City Council met in regular session on September 24, at 5:30 PM at the Municipal
Building. Mayor Joe Biard presided over the meeting. Councilmember Ford gave the invocation. Upon
roll call the following Councilmembers answered present: Jim Cargill, R.L. Carpenter, Robert Ford,
Gerald Gaither, Jerry Pectol, Paula Terrell and Jim Watkins. Councilmember Jim Mitchum was absent.
Also present were the City Clerk Denise Johnston and the City Attorney Scott Stalker.
Councilmember Ford moved to approve the minutes from the last meeting. Councilmember
Cargill seconded and all voted for.
Councilmember Ford moved to approve the prepared agenda as amended. Councilmember Terrell
seconded and all voted for.
CONSIDER A RESOLUTION FOR AIRPORT TO ACCEPT GRANT OFFER
Councilmember Watkins introduced and Mayor Biard read a resolution authorizing the Mayor and
the City Attorney to sign a grant offer agreement for improvements to the Batesville Regional Airport.
Airport manager Mary Amos said that the FAA is requiring the airport to update its safety plan. They
recommended them to broaden their current safety zone, which would require the airport to purchase 13
acres of land. Mrs. Amos said that there was 22 acres for sale, which the airport commission made an
offer on, but the offer was not accepted. The commission will now have to decide on another offer. Mrs.
Amos said the resolution is needed to receive a grant from the FAA to purchase the land needed to make
the improvements. Councilmember Watkins moved to adopt the resolution and Councilmember
Carpenter seconded. All voted for. The resolution number is 2002-9-1-R.
CONSIDER AN ORDINANCE TO AMEND THE INTERLOCAL LAW ENFORCEMENT
AGREEMENT.
Councilmember Cargill introduced an ordinance that would amend the Interlocal Law
Enforcement Agreement. The Interlocal Law Committee met on September 12, and recommended the
change. The change is in section F and only changes the wording regarding the fuel used by the metro
vehicles. Councilmember Watkins moved to suspend the rules and wave all three readings of the
ordinance. Councilmember Carpenter seconded and the roll call count was 7 for and 0 against.
Councilmember Cargill moved to adopt the ordinance and Councilmember Watkins seconded. The roll
call count was 7 for and 0 against. The ordinance was given 42002-9-1. Mayor Biard read the emergency
clause and Councilmember Watkins moved to adopt. Councilmember Cargill seconded and all voted for.
CODE ENFORCEMENT
Mayor Biard opened the public hearing at 5:43 pm to consider placing a lien on the property
located at 1165 Arch Street. The Mayor asked for any questions or comments from the audience or
council. There being no response, the Mayor closed the public hearing. Councilmember Cargill moved
to place a lien on the property located at 1165 Arch Street for $350.00 plus publication costs.
Councilmember Gaither seconded and all voted for.
Code Enforcement Office Chad McClure showed the council several pictures of properties that
have been cleaned up in the past couple of weeks.
MAYOR'S ANNOUNCEMENTS
Mayor Biard showed the council pictures of the current parking at Riverside Park and discussed
with them his proposed plan for parking. The Mayor said with is new plan they would lose about 4
parking spaces but believes that it is a better plan. The council had no objections of the new parking plan.
DISPOSAL OF PROPERTY
The council was informed of the disposal of a radio from the Landscaping Department. The
Mayor said the radio was accidentally destroyed.
FINANCIAL STATEMENTS
The council was given a copy of the financial statement for August 31, 2002.
CEMETERY RESOLUTION
The council considered a cemetery resolution for Cecil S. & Anna B. Eaton, 42002-267-1 for
$400.00. Councilmember Cargill moved to accept the resolution and Councilmember Watkins seconded.
All voted for.
There being no further business, Councilmember Gaither moved that the meeting be adjourned.
Councilmember Watkins seconded and all voted for.
