JANUARY 9, 2017
The Batesville City Council met in regular session on January 9t" at 5:30 pm at the
Municipal Building. Mayor Rick Elumbaugh presided over the meeting. Utility Billing
Supervisor Nick Baxter gave the invocation. Upon roll call, the following
Councilmembers answered present; Chris Beller, Tommy Bryant, Sonya Crafton,
Margaret Henley, Paige Hubbard, Doug Matthews, and David Shetron. Also present
were the City Clerk Denise Johnston and City Attorney Tim Meitzen. Councilmember
Chris Poole was absent.
Councilmember Bryant moved to approve the minutes from the previous
meeting. Councilmember Henley seconded and all voted for.
Councilmember Bryant moved to approve the prepared agenda. Councilmember
Shetron seconded and all voted for.

UNFINISHED BUSINESS
A) THIRD AND FINAL READING OF AN ORDINANCE TO LEVY A TAX ON
CERTAIN ACCOMMODATIONS AND AUTHORIZING THE CREATION OF AN
ADVERTISING AND PROMOTION COMMISSION
Councilmember Matthews moved to suspend the rules and read the ordinance
by title only. Councilmember Bryant seconded and the electronic roll call count
was 7 for and 0 against. Mr. Meitzen read the ordinance by title only.
Councilmember Bryant moved to adopt the ordinance and Councilmember
Henley seconded. The electronic roll call count was 7 for and 0 against. The
ordinance was given #2017-01-01. Councilmember Bryant moved to adopt the
emergency clause. Councilmember Henley seconded and the electronic roll call
count was 6 for 1 (Shetron) against.
B) THIRD AND FINAL READING OF AN ORDINANCE TO PROVIDE FOR THE
ENFORCEMENT AND COLLECTION OF TAXES LEVIED BY THE CITY ON
HOTELS AND MOTELS
Councilmember Bryant moved to suspend the rules and read the ordinance
title only. Councilmember Beller seconded and the electronic roll call count was
7 for and 0 against. Mr. Meitzen read the ordinance by title only.
Councilmember Bryant moved to adopt the ordinance and Councilmember
Henley seconded. The electronic roll call count was 7 for and 0 against. The
ordinance was given #2017-01-02. Councilmember Bryant moved to adopt the
emergency clause. Councilmember Henley seconded and the electronic roll call
count was 6 for 1 (Shetron) against.
NEW BUSINESS
A) POLICE DEPARTMENT REPORT
Police Chief Alan Cockrill said he was still working on his year-end report for the
council and asked to be on the agenda for the next meeting.
B) ENGINEER'S REPORT
City Engineer Damon Johnson addressed the council for his monthly report. He
gave the council a quick report on different jobs going on throughout the City. He
also said both processing plants are operating well.
C) FIRE DEPARTMENT REPORT
Fire Chief Brent Gleghorn addressed the council. Chief Gleghorn gave the
council a year-end report showing the total calls made and responded to for
2016. His department received 433 calls of which 63 were fire calls and 140
rescue calls. The Chief said he has found a used truck that might fit the City's
needs. It is located in Battlecreek, Michigan and the asking price is $435,000.00.
He said he thought he could get the truck for around $390,000.00. After a
discussion, Councilmember Shetron recommend that the public safety committee
meet and further discuss the City's options.
D) CONSIDER AN ORDINANCE ADOPTING THE RULES AND PROCEDURES
FOR THE TRANSACTION OF BUSINESS OF THE COUNCIL.
Councilmember Beller introduced an ordinance to adopt the rules and
procedures for the transaction of business of the Batesville City Council.
Councilmember Matthews moved to suspend the rules and read the ordinance
by title only. Councilmember Bryant seconded and the electronic roll call count
was 7 for and 0 against. Mr. Meitzen read the ordinance by title only.
Councilmember Bryant further moved to suspend the second and third readings.
Councilmember Shetron seconded and the electronic roll call count is 7 for and 0
against. Councilmember Matthews moved to adopt the ordinances and
Councilmember Bryant seconded. The electronic roll call count was 7 for and 0
against. The ordinance was given #2017-01-03.
E) CONSIDER AN ORDINANCE TO WAIVE COMPETITIVE BIDDING ON CERTAIN
ITEMS FOR 2017
Councilmember Beller introduced an ordinance to waive competitive bidding
requirements on certain items for 2017. Councilmember Matthews moved to
suspend the rules and read the ordinance by title only. Councilmember Bryant
seconded and the electronic roll call count was 7 for and 0 against. Mr. Meitzen
read the ordinance by title. Councilmember Matthews further moved to suspend
the second and third readings. Councilmember Bryant seconded and the
electronic roll call count is 7 for and 0 against. Councilmember Matthews moved
to adopt the ordinances and Councilmember Bryant seconded. The electronic
roll call count was 6 for, 0 against and 1 (Shetron) abstained. The ordinance was
given #2017-01-04. Councilmember Bryant moved to adopt the emergency
clause and Councilmember Henley seconded. The electronic roll call vote was 6
for, 0 against and 1 (Shetron) abstained.
F) EXECUTIVE SESSION
Councilmember Bryant moved to go into executive session. Councilmember
Hubbard seconded and all voted for.
Upon returning from executive session, Councilmember Matthews moved to re-
appoint Mr. Doug Lee, Mr. Terrell Tebbetts and Mr. Nelson Barnett, all to the
Historic District Commission. Councilmember Bryant seconded and all voted for.
Their terms will expire 01/08/2020.
MAYOR COMMENTS
Mayor Elumbaugh read a proclamation proclaiming January 20th Mark Martin day
for the City of Batesville. Mr. Martin will be inducted to the Nascar Hall of Fame
City Clerk Denise Johnston informed the council of 3 fixed asset disposals.
Parks, 1985 Ford F700, sold on GovDeals for$1,075.00; Street department, 1998
Dodge pickup, sold on GovDeals for $752.50 and Sanitation department, 1991 Ford
F700, sold on GovDeals for$865.37.
Mr. Johnathan Abbott addressed the council with final numbers for the Christmas
lights at Riverside Park. He said the car counter showed 37,380 cars went through the
park, however, the counter was not working for about a week so he thinks the total is
really closer to 40,000. Mr. Abbott read an email from a lady from south Arkansas who
came to Batesville to view our light display and how she and her grandkids enjoyed the
trip. Mr. Abbott said local business had donated $15,600 for new displays and he has
already had some businesses say they want to donate for 2017. The ice skating rink
did well also even though we had rain 3 of the weekends that we were open.
Councilmembers Bryant and Henley thanked Mr. Abbott and his crew for doing such a
fantastic job on the light displays.

ADJOURNMENT
There being no more business, Councilmember Matthews moved that the
meeting be adjourned. Councilmember Bryant seconded and all voted for.
