AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE THE
BATESVILLE POLICE DEPARTMENT TO PURCHASE WEAPONS AND
ACCESSORIES FROM DEFENSE SOLUTIONS GROUP, INC.
WHEREAS, the Batesville Police Department is in need of certain weapons and
accessories for the preservation of peace and safety in the City of Batesville;
WHEREAS, the Batesville Police Department requires that said weapons and
accessories meet certain specifications;
WHEREAS, Defense Solutions Group, Inc. is the only weapons provider whose
weaponry and accessories meets the specifications of the Batesville Police Department;
WHEREAS, the Batesville Police Department needs said weapons and
accessories immediately;
WHEREAS, Arkansas Code Annotated § 14-58-303 allows this governing body
by ordinance to waive the requirements of competitive bidding in exceptional situations
where bidding is deemed not feasible or practical;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE,
ARKANSAS:
Section 1. That the Batesville Police Department needs to purchase certain
weapons and accessories.
Section 2. That said weapons and accessories are to be purchased from
Defense Solution Group, Inc. for the approximate sum of $58,000, more or less.
Section 3. That because Defense Solutions Group, Inc. is the only provider of
said weapons and accessories that can meet the specifications of the Batesville Police
Department and because the department's need is immediate, competitive bidding is
deemed to not be feasible or practical and is hereby waived.
Section 4. EMERGENCY CLAUSE: That because the Batesville Police
Department's need is immediate it is further found that an emergency exists and this
ordinance being necessary for the preservation of the public peace, health and safety
shall take effect from and after its passage and approval.
