AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP; AND FOR
OTHER PURPOSES.
WHEREAS, an application was submitted to the Batesville Planning Commission for the purpose
of requesting an amendment to the Zoning Districts Map for the below referenced property; and,
WHEREAS, the Batesville Planning Commission has conducted a properly advertised public
hearing on November 2, 2015; and,
WHEREAS, the Batesville Planning Commission has reviewed the relationship of this property
with the Comprehensive Plan; and,
WHEREAS, the Batesville Planning Commission has recommended that the requested amendment
to the Zoning Districts map be approved by the City Council.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BATESVILLE, ARKANSAS THAT THE BATESVILLE ZONING DISTRICTS MAP IS
HEREBY AMENDED AS FOLLOWS:
From General Family Residential (R-2)and Light Industrial (I-1)to Commercial Community(C-1);
A tract of land being part of Section 15, Township 13 North, Range 6 West, in the City of
Batesville, Independence County, Arkansas, more particularly described as follows:
Commencing at the southwest corner of the southeast quarter of Section 15, Township 13 North,
Range 6 West, Independence County, Arkansas; thence N00°52'55"W, along the west line of the
southeast quarter of said Section 15, a distance of 1,1985 feet to a point on the former right-of-
way line of Harrison Street; thence continue N00°52'55"W a distance of 89.96 feet to a found
iron reinforcement bar with an aluminum cap at the point of beginning;thence S37°45'01"E along
the northerly right-of-way of Harrison Street as established by Arkansas Highway and
Transportation Department Job Number 050095, a distance of 40.89 feet to a found iron
reinforcement bar with aluminum cap; thence S13°37'55"E a distance of 228.35 feet to a found
iron reinforcement bar with an aluminum cap; thence S29°53'34"E a distance of 60.82 feet to a
found iron reinforcement bar with an aluminum cap; thence S48°01'55"E a distance of 96.83 feet
to a found iron reinforcement bar with an aluminum cap; thence S 39°13'35"E a distance of
151.93 feet to a found iron reinforcement bar with an aluminum cap; thence S48°58'16"E a
distance of 119.40 feet to a found iron reinforcement bar with an aluminum cap at the beginning
of a non-tangent curve which has a chord of S62°35'16"E, a distance of 26.19 feet, the radius
point of which bears N28°31'19"E a distance of 676.24 feet;thence southeasterly along the arc of
said curve through a central angle of 2'13'10" a distance of 26.19' to a set 1/2 inch iron
reinforcement bar with an identification cap; thence S 63°41'40"E a distance of 40.04'to a found
iron reinforcement bar with an aluminum cap; thence S 68°48'37"E a distance of 56.19 feet to a
found nail with a metal disk; thence S62°54'55"E a distance of 202.05 feet to a found
reinforcement bar with an aluminum cap; thence N82°05'57"E a distance of 37.45 feet to a found
iron reinforcement bar with an aluminum cap; thence S62°53'48"E a distance of 65.95 feet to a
found cotton picker spindle and identification disk; thence S31°09'40"E a distance of 41.61 feet

west right-of-way line of 30th Street a distance of 1,622.67 feet to a found 1-inch diameter iron
pipe; thence leave the west right-of-way line of 30th Street and run S88°45'37"W a distance of
1,315 feet to a set 1/2-inch iron reinforcement bar with an identification cap; thence S00°52'55"E
along the west line of the said SW 1/4 of the NE 1/4 a distance of 41.66 feet to a found 1/2-inch
iron reinforcement bar which is being used for the center of said Section 15; thence continue
S00°52'55"E along the west line of the said NW 1/4 of the SE 1/4 a distance of 498.91 feet to a
set 40d nail with a metal disk;thence leave the west line of the said NW 1/4 of the SE 1/4 and run
S42°42'34"W a distance of 67.23 feet to a set 1/2-inch iron reinforcement bar with an
identification cap; thence S37157'26"E along the northerly right-of-way line of Harrison Street as
established by Arkansas Highway and Transportation Department Job Number 050095 a distance
of 76.89 feet to the point of beginning.
IF ANY PORTION OR PORTIONS OF THIS ORDINANCE ARE DEEMED OR HELD TO
BE INVALID,SUCH INVALIDITY SHALL NOT EFFECT THE REMAINING PORTION OR
PORTIONS OF THIS ORDINANCE.
IT IS SO ORDAINED.
