AN ORDINANCE AUTHORIZING NON-CITY RESIDENT OWNERS OR
MANAGERS IN THE TOURISIM INDUSTRY TO SERVE ON THE
BATESVILLE,ARKANSAS ADVERTISING AND PROMOTION
COMMISSION; AND FOR OTHER PURPOSES.
WHEREAS,the City of Batesville, Arkansas desires to allow owners or
managers of city businesses in the tourism industry who reside outside the municipal city
limits, but within Independence County, to serve on the Batesville, Arkansas Advertising
and Promotion Commission(A&P Commission) as authorized per Arkansas Code
Annotated § 26-75-605(a)(1)(A), and
WHEREAS, Ordinance 2017-01-01 created said A&P Commission, but did not
provide that Commission Members may live outside the municipal city limits, but within
Independence County.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF BATESVILLE, ARKANSAS:
Section 1: That owners and managers of Batesville businesses in the tourism industry
who reside outside the city limits of Batesville, Arkansas, but within Independence
County, are hereby authorized to serve on the Batesville, Arkansas Advertising and
Promotion Commission.
Section 2: Emergency Clause: That said Commission is expected to commence its
duties prior to the effective date of this ordinance without declaration of emergency. Said
duties and responsibilities of the Commission are essential to the continued development
of the City and to the welfare of its citizens. Because this ordinance is necessary for the
preservation of the public peace, health, and safety, an emergency is declared to exist and
this ordinance shall be effect from and after its passage and approval.
