HomeMy WebLinkAbout2010-01-01 nn ORDINANCE NO. oC OI ` AN ORDINANCE REFERRING TO THE CITIZENS OF BATESVILLE, ARKANSAS THE QUESTION OF WHETHER OR NOT THEY WISH TO EXTEND THE TERM OF CITY ALDERMEN FROM A TWO YEAR TERM TO A FOUR YEAR STAGGERED TERM PURSUANT TO ARKANSAS LAW. WHEREAS, the City of Batesville, a City of the First Class having fewer than fifty thousand inhabitants, currently has eight aldermen which represent four wards within the City, and WHEREAS, the City Council believes the best interests of the City will served by changing the terms of office for aldermen from two year terms to staggered, four year terms to provide better continuity and stability in City government, and WHEREAS, the City Council desires to refer to the voters of the City the opportunity to change the terms of office for aldermen as allowed by Arkansas Law. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE, ARKANSAS, THAT: SECTION 1: The Batesville City Council hereby refers to the voters of Batesville, Arkansas the question of whether or not they wish to extend the term of office of aldermen from a term of two years to a term of four years and for said four year terms to be staggered pursuant to Arkansas Code Annotated 14-43-312 with said terms to begin as a four year term for Position One in each of the four wards in the 2012 General Election and the term for Position Two in each of the four wards to begin in the General Election in 2014. SECTION 2: The ballot title shall read: "An ordinance changing the term of Batesville City Aldermen from a two year term to a four year term pursuant to Arkansas Code Annotated 14-43-312 with said terms to begin for Position One as of the 2012 General Election and said terms for Position Two to begin as of the 2014 General Election, resulting in staggered terms with one alderman being elected to a four year term from each ward in the City of Batesville, Arkansas every two years." FOR AGAINST x SECTION 3: A copy of this ordinance shall be delivered to the Independence County . Election Commission in a timely manner for inclusion and coordination with the 2010 General Election. SECTION 4: All ordinances and parts of ordinances in conflict herewith are hereby repealed. SECTION 5: If any portion or portions of this ordinance are deemed or held to be invalid, such invalidity shall not effect the remaining portion or portions of this ordinance. EMERGENCY CLAUSE: Whereas it is necessary to effect the public peace, health, safety and welfare and the orderly administration of the City an emergency is hereby declared to exist and this Ordinance shall be effective from and after the date of its passage.
