DECEMBER 18, 2017
The Batesville City Council met in regular session on December 18th at 5:30 pm at the
Municipal Building. Mayor Rick Elumbaugh presided over the meeting. Utility Billing
Manager Nick Baxter gave the invocation. Upon roll call, the following Councilmembers
answered present; Chris Beller, Tommy Bryant, Margaret Henley, Paige Hubbard, Doug
Matthews, Chris Poole and David Shetron. Also present were the City Clerk Denise
Johnston and City Attorney Tim Meitzen. Councilmember Sonya Crafton was absent.
Councilmember Bryant moved to approve the minutes from the previous
meeting. Councilmember Shetron seconded and all voted for.

A) SECOND READING OF AN ORDINANCE TO AMEND THE BATESVILLE
ZONING CODE REGARDING PLANNED DEVELOPMENT
A proposed ordinance to amend the Batesville Zoning Code regarding planned
development was considered for the second reading. Councilmember Bryant
moved to read the ordinance by title only. Councilmember Shetron seconded
and the electronic roll count was 7 for and 0 against. Mr. Meitzen read the
ordinance by title only. Councilmember Shetron moved to suspend the third and
final reading and Councilmember Bryant seconded. The electronic roll call count
was 7 for and 0 against. Councilmember Bryant moved to adopt the ordinance
and Councilmember Shetron seconded. The electronic roll call count was 7 for
and 0 against. The ordinance was given #2017-12-01.
B) SECOND READING OF AN ORDINANCE TO AMEND THE BATESVILLE
ZONING CODE REGARDING LIMITATIONS PLACED ON LOCAL MOBILE
FOOD VENDORS
A proposed ordinance to amend the Batesville Zoning Code regarding limitations
placed on local mobile food vendors was considered for its second reading.
Councilmember Bryant moved to read the ordinance by title only.
Councilmember Beller seconded and the electronic roll call count was 7 for and 0
against. Mr. Meitzen read the ordinance by title only. Councilmember Bryant
moved to suspend the third and final reading and Councilmember Beller
seconded. The electronic roll call count was 7 for and 0 against.
Councilmember Beller moved to adopt the ordinance and Councilmember Bryant
seconded. The electronic roll call count was 7 for and 0 against. The ordinance
was given #2017-12-02.
C) SECOND READING OF AN ORDINANCE TO AMEND THE BATESVILLE
ZONING CODE REGARDING THE ESTABLISHMENT OF FOOD COURTS
WITHIN THE CITY
A proposed ordinance to amend the Batesville Zoning Code regarding the
establishment of food courts within the city was considered for its second reading.
Councilmember Bryant moved to read the ordinance by title only. Councilmember
Henley seconded and the electronic roll call count was 7 for and 0 against. Mr.
Meitzen read the ordinance by title only. Councilmember Bryant moved to suspend
the third and final reading and Councilmember Henley seconded. The electronic
roll call count was 7 for and 0 against. Councilmember Bryant moved to adopt the
ordinance and Councilmember Beller seconded. The electronic roll call count was
7 for and 0 against. The ordinance was given #2017-12-03.
NEW BUSINESS
A) CONSIDER A RESOLUTION LEVYING FEES FOR TRASH AND GARBAGE
PICKUP SERVICE
Mr. Meitzen read a resolution to consider levying fees for the trash and garbage
pickup services in Batesville. The council discussed the provisions in the
resolution for low income individuals had not been increased for several years.
After agreeing to raise the low income level from $10,000.00 annually to
$14,000.00, Councilmember Shetron moved to table the resolution until
corrections can be made. Councilmember Beller seconded and all voted for.
B) CONSIDER A RESOLUTION FOR THE ADOPTION OF THE 2018 BUDGET
FOR THE CITY OF BATESVILLE
The council considered a resolution to adopt the 2018 budget for the City of
Batesville. Councilmember Bryant moved to read the resolution by title only.
Councilmember Henley seconded. The electronic roll count was 7 for and 0
against. Mr. Meitzen read the resolution by title only. Councilmember Bryant
moved to adopt the resolution and Councilmember Shetron seconded. The
electronic roll call count was 7 for ad 0 against. The resolution was given 2017-
12-01-R.

C) PAID BILLS REPORT
The council was given a copy of the November, 2017 paid bills report for
reviewing.
MAYOR ANNOUNCEMENTS
Mayor Elumbaugh said he has a conflict with the first meeting in January and
asked the council to reschedule next month's meeting from Tuesday the 9t" to Monday
the 8t". Councilmember Matthews so moved and Councilmember Bryant seconded.
All voted in favor. Mayor Elumbaugh reminded the council that he and several others
will be out of the office January 10-12 to attend the Municipal League Fall Conference.
Batesville is being awarded 4 achievement awards from Trendsetter magazine and will
be in presented the awards at the Municipal League conference. . Because of our
large number of awards, the city will be in the running for the best all around.
The Mayor also commended Johnny Abbott and his crew for another beautiful
display of Christmas lights in Batesville. He said he has had wonderful comments from
local and visitors alike.
Police Chief Alan Cockrill addressed the council regarding an officer involved
shooting recently at the US Pizza parking lot. He said two of our officers were involved
in a traffic stop that ended up with a suspect pulling a gun on our officers. Our officers
fired at the suspect, injuring him in the process. Unfortunately a passing vehicle was hit
by a round of gun fire. The Mayor authorized him to get the owners of the vehicle a
rental car while theirs is being repaired. He said the state police have the body
cameras in their possession and are currently reviewing the incident.
City Clerk Denise Johnston said she had two fixed asset removals. Unit#535, a 2005
Crown Vic. For$645.00 on GovDeals. Also Unit#738, 1997 Chev., for $2,483.25 on
GovDeals.

There being no more business, Councilmember Bryant moved that the meeting
be adjourned. Councilmember Hubbard seconded and all voted for.
