HomeMy WebLinkAbout922V� ORDINANCE # 9 AN ORDINANCE AMENDING ORDINANCE #614 § 1 AND 3, § 5.12.01 AND § 5.12.02 OF TITLE 5 OF THE BATESVILLE MUNICIPAL CODE PROVIDING COLLECTION OF SOLID WASTE AND FOR A GARBAGE DISPOSAL TAX; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES. BE IT HEREBY ORDAINED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS: Section 1: That Ordinance #614 § Section 1 §5.12.01 of Title 5 of the Batesville Municipal Code is hereby amended to read as follows: "All garbage, waste, trash, tin cans and refuse in the City shall be collected regularly by the employees of said City, and no other person, firm or corporation shall be allowed to collect said garbage, waste, trash, tin cans and refuse except employees of the City. Provided that this Ordinance does not preclude a person, firm or corporation from pro- perly disposing of its own garbage, waste, trash, tin cans and refuse at some location outside the city limits; Provided further that it shall not be a defense in a lawsuit brought by the city to collect the garbage disposal tax provided for in §5.12.02 of this code that the defendant has disposed of his own garbage, waste, trash, tin cans and refuse." Section 2: That Ordinance #614 ss Section 3 §5.12.02 of Title 5 of the Batesville Municipal Code is hereby amended to read as follows: "That whereas, the services provided for by this ordinance are for the benefit of all citizens of the City of Batesville and are necessary for the protection of the health and welfare of the City and its citizens, a garbage disposal tax is hereby established and is to be collected by the City. Said tax is to be paid by the residents and occupants of each residence and business located in the City of Batesville. The amount of tax to be levied on a particular residence or business will be determined by resolution adopted by the City Council." Section 3: All ordinances or parts of ordinances which conflict with the provisions of the within ordinance are hereby repealed. Section 4: This ordinance being necessary for the safety, well- being and welfare of the public, an emergency is hereby declared to exist and this ordinance shall be in full force and effect from and after the date of its passage. _l Passed and adopted on this _day of` Uvrt 44Avl 1980.
