HomeMy WebLinkAbout928BEFORE THE CITY COUNCIL FOR THE CITY OF BATESVILLE, ARKANSAS ORDINANCE NO. 9,� Y AN ORDINANCE REZONING PART OF THE NORTHWEST QUARTER OF SECTION 14, TOWNSHIP 13 NORTH, RANGE 6 WEST IN CITY OF BATESVILLE, ARKANSAS WHEREAS, Mobley Lumber Company is the owner of the following described lands lying in the City of Batesville, Arkansaj TRACT A: A tract of land in the NW4 of Section 14, Township 13 North, Range 6 West, Batesville, Independence County, Arkansas, and more particularly described as follows: Commencing at the SW Corner of said NW4; thence S 89°55'05" E along the South Line of said NW4 a distance of 893.15 feet to a point on the West Right -of -Way Line of Arkansas Hwy. No. 69; thence N 40°12'20" E along said West Right -of -Way Line a distance of 125.00 feet to the Point of Beginning of the tract herein described; said Point of Beginning being at the intersection of the West Right -of -Way Line of Arkansas Hwy. No. 69 and the North Right -of - Way Line of Sawmill Road; thence continuing along the West Right of Way line of Arknasas Hwy. No. 69 N 40°12'20" E a distance of 200.00 feet; thence N 39°23'49" W a distance of 174.42 feet to the Southeast Corner of Lot 35 of the First Addition to Sawmill Subdivision; thence N 76006'46" W along the South Line of said Lot 35 a distance of 120.78 feet to a point on the East Right -of -Way Line of Sawmill Road; thence following said East Right -of -Way Line S 4021'32" W 81.90 feet; S 7°57'16" E, 100.32 feet to a point of curvature; thence along a curve to the left having a radius of 175.00 feet a distance of 127.79 feet to a point of tangency; thence S 49°47140" E a distance of 40.38 feet to the Point of Beginning. Containing 1.03 acres, more or less. TRACT B: A tract of land in the NW4 of Section 14, Township 13 North, Range 6 West, Batesville, Independence County, Arkansas, and more particularly described as follows: Commencing at the SW corner of said NW4; thence S 89°55'05" E along said South Line of said NW4 a distance of 893.15 feet to a point on the West Right -of -Way Line of Arkansas Hwy. No. 69; thence N 40°12'20" E along said West Right -of -Way Line a distance of 325.00 feet to the Point of Beginning of the tract herein described; thence continuing along said Right -of -Way N 40°12'20" E a distance of 22.86 feet to a point of curvature; thence following said Right -of -Way on a curve to the right having a radius of 786.25 feet a curve distance of 754.39 feet to a point of tangency; thence continuing along said Right -of -Way S 84°49'22" E a distance of 276.29 feet to the Southwest Corner of a 9.2 acre tract presently zoned C-lA; thence N 5°10'38" E along the West Line of said tract a distance of 550.00 feet; thence N 85000149" W a distance of 597.81 feet; thence along a curve to the left having a radius of 375.00 feet a curve distance of 123.34 feet to a point of tangency; thence S 72°22'20" W a distance of 71.12 feet to a point of curvature; thence along a curve to the right having a radius of 625.00 feet i !i a curve distance of 62.36 feet; thence S 22°11'07" W a distance of 732.32 feet to the Southeast Corner i of Lot 35 of the First Addition to Sawmill Subdivision; ;; thence S 39°23'49" E a distance of 174.42 feet to the Point of Beginning. Containing 13.40 acres, more I or less; and WHEREAS, the owners of said property have requested the rezoning of said Tract A from R-1 residential zoning to R-2 ;residential zoning; and WHEREAS, the owners of said property have requested the rezoning of said Tract B from R-1 residential zoning to C-lA commercial zoning; and WHEREAS, the Planning Commission has held a public hearing on such request, after proper notice having been published in the manner and for the time required by law; and WHEREAS, the City Council for the City of Batesville, Arkansas, has received a recommendation from the Planning Commission that said Tract A be rezoned from R-1 residential to R-2 residential, and WHEREAS, the City Council for the City of Batesville, Arkansas, has received a recommendation from the Planning Commission that said Tract B be rezoned from R-1 residential to C -IA commercial; and WHEREAS, the City Council finds that the recommendation of the Planning Commission should be accepted and the property be rezoned, BE IT THEREFORE ORDAINED that the real property described herein as Tract A be rezoned from R-1 residential to R-2 residential and that Tract B be rezoned from R-1 residential to C-lA commercial and that this ordinance be published one time in !a newspaper having a general circulation in the City of.
