AN ORDINANCE PROHIBITING THE DISCHARGE OF FIREARMS WITHIN THE CITY LIMITS
OF THE CITY OF BATESVILLE; PENALTIES FOR VIOLATION; AND FOR OTHER PURPOSES:
BE IT ORDAINED by the City Council of the City of Batesville, Arkansas:
I. It shall be unlawful for any person to purposely, knowingly or
recklessly discharge or fire or cause to be discharged or fired any fire-
arm including rifles, shotguns and handguns within the city limits of
Batesville.
2. It shall not be a violation of this ordinance if said firearm
is discharged or fired or caused to be discharged in order to scare off
or prevent the roosting of blackbirds or other birds in the city limits
provided that the Mayor or his designated agent has declared an emergency
situation to exist and the user of said firearm has obtained written
authorization from the Mayor or his designated agent to use the firearms
said authorization shall state specific times and dates on which the
firearms may be used for this purpose.
3. Any ordinance or part of any ordinance in conflict with the pro-
visions herein are hereby repealed.
4. If any part or parts, sentence or sentences of this ordinance
are determined to be invalid, that portion shall be deemed severed from
the remaining valid portions of this ordinance and those valid portions
shall remain in effect and valid for all purposes.
5. Any person violating this ordinance shall upon conviction thereof,
be adjudged guilty of a violation and fined in a sum not to exceed $100.00
for each offense.
