ORDINANCE NO. q33
AN ORDINANCE REZONING CERTAIN PROPERTY IN THE CITY
OF BATESVILLE LYING IN SECTION 4, TOW14SHIP 13 NORTH,
RANGE 6 WEST IN INDEPENDENCE COUNTY, ARKANSAS.
WHEREAS, by Ordinance No. 930 the following described lands
in Independence County', Arkansas were annexed, to the City of
Batesville, Independence County, Arkansas, to -wit.
TRACT 1: Beginning at the intersection of the North
right-of-way line of Arkansas State Highway No. 25
and the West line Southeast Quarter (SE4-) of South-
east Quarter (SE4-), Section 4, Township 13 North,
Range 6 West, thence along above said right-of-way
line in an easterly direction for a distance of
200 feet to a point; thence at .right angles to above
said right-of-way line in a Northly direction a distance
of 200 feet; thence at right angles to East described
course a distance of 200 feet to a point on the test
line of SE4 of SE'« of above described Section 4; thence
in a Southerly direction along said quarter section
line a distance of 200 feet to the point of beginning,
containing one (1) acre, more=- or less, except. mineral
rights.
TRACT 2: A part of the Southeast .Quarter (SE4) of
the Southeast Quarter (SE4) of Section 4, Township
13 North, Range 6 West, described thus: Beginning at
the intersection of the North right-of-way line of
Arkansas State Highway No. 25 and the West line of
the SE4- of the SE -14 of Section 4, Township 13 North,
Range 6 West; thence in an Easterly direction along
said right-of-way line a distance of. 200 feet +-n the
point of beginning of the land herein conveyed; thence
at right angle to said right-of-way line and in a
northerly direction 515 feet to a point; thence in an
easterly direction and parallel to said Iiighway right-
of-way line 422 feet; thence in a Southerly direction
and parallel to the West line of said SE4 of the SE4-
a distance of 515 feet to said right-of-way line;
thence Westerly along said Highway right-of-way line
a distance of 422 feet to the point of beginning of
the land herein conveyed, containing five acres, more
or less, EXCEPT mineral rights.
WHEREAS, the City Planning Commission of the City of Batesvi.11
Arkansas, has recommended to the Batesville City Council that said
lands as annexed and as described above be zoned C-2;
WHEREAS, the Council has determined that the property's best
use is commercial and that the property should be zoned under the
classification C-2; and that the general public interest and
welfare will not be adversely affected by said rezoning.

NOW, THEREFORE, BY IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF BATESVILLE, ARKANSAS:
Section 1. That the lands described herein shall
be zoned C-2.
Section 2. A copy of the ordinance duly filed by
the City Clerk shall be filed in the Office of the
Recorder of the County and recorded in the deed records
of the County.
