AN ORDINANCE TO AMEND ORDINANCE NO. 892 OF
1978 PROVIDING FOR BI -ANNUAL REVIEW OP COST
OF OPERATION SOF WASTEWATER FACILITY AND
MODIFICATION OF' USER CHARGES.

WHEREAS, the Utility Commission of tree City of Batesville,
i
Arkansas is charged with the responsibilities of operating arid
maintaining the Batesville Wastewater System in accordance with
all applicable local, state, and federal laws; and
WHEREAS, the City of Batesville is the recipient of a

`grant of funds from the United States Government (EPA Project No. I
C-05-0332-03) to finance in part the Batesville Wastewater Pumping;
and Treatment Facility; and
WHEREAS, 40 CFR 35.929 et seq, 40 CPR 35.935-13 and
,Appendix B thereto, provide for bi-annual review of costs of
operation and maintenance of wastewater facilities;
NOW, THEREh'ORE, BE IT ORDAINED BY THE CITY COUNCIL Ol,'
,THE CITY OF BATESVILLE, ARKANSAS AS FOLLOWS :
1. The City of Batesville shall, by and through the
Batesville Utilities Commission, not less frequently than bi-
''annually, hereafter review the cost of operation arid maintenance
of the Batesville Wastewater Facility.
2.After review the City shall, by ordinance or other -

I!wise, increase if necessary, the rates charged to residential and
i'.
commercial users to a rate which will insure a sufficient fund for
(1) operation and (2) maintenance of the aforementioned wastewater
facility.
3. The cost of maintenance as used hereinabove shall
include the cost of replacement of the wastewater treatment
facility .
ii 4. Each user shall be notified, at least annually,
!Tin conjunction with the regular bill, of the rate and that portion
k of the user charges which are attributable to wastewater treatment

services.
5. The computation cf applicable rate shall insure a
proportional distribution of operation and maintenance cost to
each user based upon the factors of strength, volume and delivery;
flow rate characteristics of the discharge into the wastewater
treatment facility system.
6. All ordinances and parts of ordinances in conflict

i! herewith are hereby repealed.
7. There is an immediate and urgent need for the
prompt passage of this ordinance for the proper administration
of municipal affairs, in completing a sewer improvement project
funded in part by the United States of America; therefore, an
emergency exists, and this ordinance being necessary for the
protection of the public health, safety and welfare, shall take

effect and be enforced from and after its passage, approval
i
and publication.
