AN ORDINANCE AUTHORIZING MONTHLY
SERVICE CHARGE TO INACTIVE WATER ACCOUNTS
WHEREAS, the City of Batesville, Arkansas, by and through
its agent, Batesville Utilities Commission, maintains its records
and accounts for customers of the Batesville Waterworks; and,
WHEREAS, a deposit is required of all customers for
commencement of service; and,
WHEREAS, some customers terminate their water service and
leave no forwarding address, leaving in the hands of the
Batesville Waterworks a sum of money equal to or less than the
aforementioned deposit; and,
WHEREAS, it is necessary to carry forward the balance of
each account and perform all and sundry bookkeeping functions
pertaining to the account thus continued; and,
WHEREAS, the continuing function of the Utilities Commiss
results in an expenditure of funds which is not offset by any
source of income.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BATESVILLE:
1. That each account of a customer who has terminated his,
her or its water service, leaving a balance of funds on deposit,
and no address to which to deliver such funds, shall be charged
the sum of TWO DOLLARS ($2.00) per month service charge for the
maintenance of his, her or their account, so long as a positive
balance remains in such account.
2. There is an immediate and urgent need for the prompt
passage of this ordinance for the proper administration of
municipal affairs; therefore, an emergency exists, and this
ordinance being necessary for the protection of the public health,
safety and welfare, shall take effect and be enforced from and
after its passage, approval and publication.
PASSED and APPROVED by the City Council of the City of
