EM <br />ORDINANCE NO. 2419 <br />9 <br />AN ORDINANCE PROVIDING FOR AN OCCUPATION (LICENSE) TAX THAT <br />THE ARKANSAS LOUISIANA GAS COMPANY SHALL PAY TO THE CITY OF <br />BATESVILLE, ARKANSAS, FOR THE YEAR 1981, AND FUTURE YEARS: <br />PROVIDING FOR THE PAYMENT THEREOF: DECLARING AN EMERGENCY: <br />AND FOR OTHER PURPOSES. <br />WHEREAS, the Arkansas Louisiana Gas Company (hereinafter called the <br />"Gas Company") is duly authorized by franchise ordinance to operate a gas <br />distribution system and to render gas service to the City of Batesville, <br />Arkansas, and to the citizens thereof, and, <br />WHEREAS, said Gas Company is now occupying the streets and alleys <br />of said Municipality for the purpose of supplying gas service to said <br />Municipality and its citizens, and, <br />WHEREAS, the Municipality is entitled to receive such just and <br />reasonable taxes from the Gas Company which the Municipality may lawfully <br />impose, <br />:901: <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE, <br />SECTION I. There is hereby levied an annual Occupation (License, <br />Privilege, Franchise, or other special city) Tax to be paid by Arkansas <br />Louisiana Gas Company for the year 1981, and future years until changed <br />by ordinance, in the amount of $50,000 annually. <br />SECTION II. Said Tax for the year 1981, shall be paid in four (4) <br />equal quarter annual installments of $12,500 each, beginning March 15, 1981, <br />and on June 15, 1981, September 15, 1981, and December 15, 1981. An amount <br />equal to the amount of said tax shall be collected by the Gas Company from <br />its domestic and commercial customers in the City of Batesville in accord- <br />ance with the Rules and Regulations of the Arkansas Public Service Comm - <br />fission. <br />SECTION III. Nothing herein shall be construed to alter or change the <br />terms or conditions of the present franchise under which the Gas Company is <br />operating. <br />SECTION IV. All other ordinances, agreements and parts of ordinances <br />and aareements in conflict with the provision of this Ordinance are hereby <br />repealed. <br />
