AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE THE
PURCHASE OF EQUIPMENT FOR THE CITY OF BATESVILLE UTILITY
DEPARTMENT
WHEREAS,the City of Batesville Utility Department is in need of equipment
immediately,and time is of the essence for the purchase of this particular piece of equipment.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE,
ARKANSAS:
Section 1. That the City of Batesville Utility Department needs to purchase a certain
Kubota Mini-Excavator.
Section 2. That this particular equipment is available immediately and not likely to be
available for such a favorable purchase price in the near future.
Section 3. That this piece of equipment is a new 2007 Model Kubota 161 Mini-
Excavator which has never been sold.
Section 4. That the purchase price of this equipment is approximately Fifty One
Thousand Four Hundred Dollars ($51,400.00).
Section 5. That the City Council, in accordance with the terms of Arkansas Code
Annotated §14-58-303, hereby waives the requirement of competitive
bidding and directs the Purchasing Officer to purchase the above described
equipment for the approximate price set forth in Section 4 herein.
EMERGENCY CLAUSE: Whereas, it is necessary to purchase the above described
equipment immediately, and this ordinance being necessary
to effect the public peace, health, safety and welfare and the
orderly administration of the City, an emergency is hereby
declared to exist and this ordinance shall be in full force
and effect from and after its passage.
IT IS SO ORDAINED.
