AN ORDINANCE DEFINING RESIDENTIAL, COMMERCIAL
j AND INDUSTRIAL USERS OF THE BATESVILLE,

ARKANSAS WATER AND SEWER SYSTEM.
WHEREAS, the City of Batesville, Arkansas is charged
with the operation and maintenance of a water and sewer system
I
I in accordance with all applicable local, state and federal laws;

and,
WHEREAS, the United States Environmental Protection
Agency (EPA) has required as a grant condition for the receipt
of grant funds (EPA Project #C-05-0332-03) to define the
categories of users of the water and sewer system; and to
establish charges for the use of the system;
NOW, THEREFORE, BE IT HEREBY ORDAINED BY THE CITY OF
BATESVILLE, ARKANSAS that hereafter the following definitions
shall apply and be used in interpretation or construction of

Batesville water and sewer use regulations and ordinances, to -wit:
�i 1. Residential Users are defined as those using water
or sewer services in or appurtenant to a structure used or
�. designed for use as a dwelling place, whether for single or
i!
{ multiple occupancy, excluding hotels and motels.
kk 2. Commercial Users are defined as those using water

or sewer services in or appurtenant to a structure used or
designed for use as a place of business, including hotels and
motels, but excluding industrial users.
3. Industrial Users are defined as those using water
or sewer services in or appurtenant to a structure or enclosure
used or designed for use as a place for manufacturing or process
ing goods.
! 4. All users heretofore categorized as commercial j
users shall henceforth, according tothe activity carried on upon
the premises, or the purpose for which the premises are designed
be categorized as either a commercial or industrial user.

5. All laws or parts of laws in conflict herewith are
hereby repealed.
6. The rates heretofore established by ordinance for

�? use of water shall also apply to industrial users. The sewer

rates heretofore established by ordinance for use of the waste-
r
�f water system by commercial users shall also apply to industrial
i' users. '

The City Council of the City of Batesville, Arkansas,
ii
hereby finds that there is an immediate and urgent need for the
�i
prompt passage of this ordinance for the proper administration
If
!: of municipal affairs; therefore, an emergency exists, and this
it
t
ordinance being- necessary for the protection of the public peace,i
jl health, safety and welfare, shall take effect and be enforced
i�
is
from and after its passage, approval and publication.
PASSED and APPROVED by the City Council of the City
of Batesville, Arkansas, this the 1 Q day of
1981.
