AN ORDINANCE PROVIDINCI FOR SINGLE WATER METER
CONNECTIONS FOR MULTIPLE USE STRUCTURES.
WHEREAS, the City of Batesville, Arkansas, has in
force and effect Ordinance No. 681 of 1961, sub -part 6, a portion
of which regulates the installation of water meters, and
establishes minimum user charges; and,
WHEREAS, changes in building methods and in energy

requirements have resulted in alternative plumbing; methods; and, 1
WHEREAS, inequities have resulted from the requirements;
of prior provisions; and,
WHEREAS, it is in the public interest to allow alter-
native water meter installation practices; !
NOW, THEREFORE, IT IS HEREBY ORDAINED BY THE CITY
COUNCIL OF BATESVILLE, ARKANSAS:
1. That §6(a)(3) of Ordinance No. 681 of 1961 should
be and is hereby modified and amended to strike therefrom the
following words and phrases:
"Meters shall be installed at each water
connection at all buildings, both public and
private. In the case of apartment buildings
or houses, a separate meter shall be installed
for each family unit";
and to substitute therefor the following:
"Meters shall be installed at all buildings
both public and private. At the option of the
owner of the building or buildings, multiple
meters may be installed and separate connections
may be made for buildings having multiple
occupancy or a single meter may be utilized.
In the event that a single meter is utilized
for a building having multiple occupancy,
except hotels and motels, the water use _c,ate
shall be calculated by multiplyinc; the number
of units x the single occupancy user rate.
Mobile home parks, apartment complexes, and
other similar aggregates having more than one
structure in a group utilizing a single meter
shall be subject to the same rate as multiple
occupancy single buildings.
Hotels and motels shall be and are hereby
classified as single occupancy structures and

shall be subject to the water use rate of
i a single occupancy structure."
j 2. The provisions of this ordinance are hereby

'i declared to be separable and if any provision shall for any
reason be held illegal or invalid, it shall not affect the

validity of the remainder of the ordinance.
3. All ordinances and resolutions and parts thereof
in conflict herewith are hereby repealed to the extent of such
conflict.
4. In order to alleviate the requirements of prior

law upon new construction, it is declared that an emergency
exists and this ordinance being; necessary to the preservation
ii
of the public health, welfare and safety shall take effect from
?i and after the date of its passage.
