HomeMy WebLinkAbout957ORDINANCE NO._IfL-':7 AN ORDINANCE PROVIDING FOR THE RE -ZONING OF PROPERTY OWNED BY THE NORTH ARKANSAS CHRISTIAN SCHOOL, INC. WHEREAS, the Batesville Planning Commission of the City of Bates- ville, Arkansas, pursuant to law has filed its recommendations with the Batesville City Council recommending that the following described prop- erty be re-classified and that said proposed change would be to the best interest of the City of Batesville, to -wit: The North 140 feet of Lots One (1) and Two (2) in Block Sixty (60) of Maxfield's Third Eastern Addition to the City of Batesville, Arkansas. That said property is owned by the North Arkansas Christian School, Inc. and should be re-classified as C-2 and that said proposed change would be to the best interest of the City of Batesville. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE, ARKANSAS: Section 1. The Batesville City Council adopts the report and rec- ommendation of the Batesville Planning Commission as set forth and that the above described property located in the City of Batesville, Arkansas, be and the same hereby is re-classified under the applicable zoning law and regulations to the classification of commercial C-2 property. Sect, 2. The City Clerk shall cause the City Zoning Map to note the change as above set forth. Section 3. There is hereby found and declared to be an immediate need for the re-classification above set forth for the benefit of the public health, safety and welfare of the City of Batesville, Arkansas, and particularly the area affected hereby. NOW, THEREFORE, it is declared an emergency exists and that this ordinance is necessary for the immediate preserver,;ion of public health, safety and welfare, and shall be in full force and effect immediately upon its passage. ATTEST: rDp�a� Larry Wil Tams, City Clerk CM (e) Lot Two of Heuer's Subdivision as shown by the amended plat dated July 25, 1955, and filed for record on August 4, 1955, in Deed Book A-7, at pages 35-36 of the records of Independence County, Arkansas, and being a part of Section 3, Township 13 North, Range 6 West, in Independence County, Arkansas. 4. The following tracts of land should be and are hereby zoned R-2: (a) A part of the Southeast Quarter of Section 3, Township 13 North, Range 6 West, described as follows: Beginning at the intersection of an old County Road (Old Highway #11) and the East R/W line of the present Highway 394; thence North 35 degrees 40 minutes East along the East Highway R/W line 208.6 feet, more or less, to the Williams property line; thence East 269.5 feet along the Leftwich -Williams property line to an iron pipe in the fence line for a Point of Beginning; thence continue East along the said property line 147 feet; thence Northeasterly with the Williams property line 242.9 feet to the South line of the Theatre tract; thence East along the Theatre property line 405.9 feet; thence South 3 degrees West with the extension of the East line of the Theatre tract 209.9 feet; thence East 724 feet, more or less to the center of Miller Creek; thence Southerly along Miller Creek to the North R/W line (15 feet from center line) of an Old County Road; thence along the North R/W line 1292 ft. West, more or less, to an iron pin; thence North 142 feet to the Point of Beginning. (b) Part of the Southeast Quarter (SE -1,), Section 3, Township 13 North, Range 6 West, to wit: From a point on the North right of way of Arkansas Highway 25 which is described as being 50 feet North and 18 feet East from the SW corner of the said SE,'-,, Section 3, run East along the North right of way line of said Highway 25 a distance of 928.5', more or less, to a point which is 531.5' East of the SE corner of a tract of land heretofore deeded to Billy Cargill and the point of beginning; then run North, parallel with and 271.5' East from the East boundary of a tract of land heretofore deeded to Ernest Forbes, a distance of 1200.0' to the middle of Old Dethrow Road, then run East along the middle of said road 1068.5', more or less, to the center of a creek; then run Southerly, along the center of said creek a distance of 1300.0', more or less, to the North right of way line of Arkansas highway 25; then run West along said North highway right of way line 969.5', more or less, to the point of beginning, being 30.0 acres, more or less. 5. The following tract of land should be and hereby is zoned I-1: (a) A tract of land being a part of the Southeast Quarter of Section Three of Township Thirteen North and Range Six West of the Fifth Principal Meridian (SE4 Sec. 3 T13N R6W, 5th PM) in Independence County, Arkansas, more particular described as follows: I Commencing at the South Quarter Section Corner of Said Section 3; thence S 890 51' 00" E a distance of 919.50 feet, thence N 1° 00' 00" W, a distance of 566.60 feet to the z Point of Beginning; thence S 89° 02' 00" W a distance of 874.59 feet to a point on the East Right-of-way line of U. S. 14W y Highway 167; thence N 90 42' 00" E along said Egst right-of- way line, a distance of 76.32 feet• thence N 89 02' 00" E, a distance 586.81 feet; 8thence N la 00' 00" W, a distance of 436.13 feet, thence S 89 02' 00' W, a distance of 189.72 feet, thencS N 350 02' 03" E, a distance of 210.05 feet; thence N 89 22' 40" E, a distance of 339.77 feet; thence South S l0 00' 00" E, a distance of 679.02 feet to the Point of Beginning. Containing 5.79 Acres, more or less. 6. It is hereby found and declared that an emergency exists and that this ordinance, being necessary for the public welfare, it shall be in full force in effect from the date of its passage.
