AN ORDINANCE REPEALING ORDINANCE #708, CODIFIED AS CHAPTER 14.12 OF THE
' BATESVILLE MUNICIPAL CODE, PERTAINING TO RES'T`RICTIONS ON MOBILE HOMES,
DECLARING AN EMERGENCY AND FOR OTHER PURPOSES:

!'. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS:
1. That Ordinance #.708, codified as Chapter 14.12 of the Batesville Municipal
Code and pertaining to restrictions on mobile homes, is hereby repealed.

2. The City Clerk shall remove said chapter from the Batesville Code and shall;

mark Ordinance #708 to show it repealed.
a 3. That it is the intention of this Council that the provisions of the

Batesville Planning Commission's zoning regulations incorporated by reference
and made a part of the Batesville Municipal Code in 1978 shall control any and
all questions affecting or concerning mobile homes.
4. Whereas, Ordinance #708 was erroneously made a part of the Batesville Municipal
Code when codified in 1978; whereas Ordinance #708 and the Batesville Zoning
Ordinance are in direct conflict with each other; and whereas the provisions
of Ordinance #708 adversely affect the value of the property in Batesville, an
emergency is hereby declared in order to protect the public health, safety and,
welfare and this ordinance shall bein full full force and effect from and
after the date of its passage.
