AN ORDINANCE LE'VING AN ADDITIONAL MUNICIPAL COURT COST OF THREE DOLLARS ($3.00)
ON EACH MISDEMEANOR AND TRAFFIC OFFENSE BROUGHT IN THE BATESVILLE MUNICIPAL
COURT; CREATING THE CRIMINAL JUSTICE FUND; PROVIDING FOR USE OF SAID FUND TO
BE TO DEFRAY COST OF USE OF THE COUNTY JAIL BY CITY PRISONERS, DECLARING AN
EMERGENCY AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS:
Section 1: An additional Three Dollars ($3.00) is hereby levied and shall be
collected by the Batesville Municipal Court as Court Costs from each defendant
upon a plea of guilty, nolo contendre, forfeiture of bond or determination of
guilt for all misdemeanors and traffic offenses brought before said court.
Section 2: The City Clerk is hereby authorized and directed to establish a
fund to be known as the Criminal Justice Fund and all monies collected by the
levy of the additional court costs shall be deposited to the credit of said
Criminal Justice Fund.
Section 3: All monies deposited in said fund shall be for the sole and
exclusive purpose of paying expenses incurred by incarcerating city prisoners
in the County Jail.
Section 4: The cost of incarcerating prisoners in the County Jailis a major
expense upon the City and due to its nature not possible to effectively budget;
therefore a fund with independent sources and liabilities is required; further-
more, said costs and fund are necessary for good law enforcement and for the
protection of the citizens of Batesville's health, safety and welfare; there-
fore, an emergency is declared and this ordinance shall be in full force and
effect from and after the date of its adoption.
