An Ordinance rezoning the following described property from R-1 residential to C-2 commercial: A part of the Northwest Quarter of the Northeast Quarter of Section 8, Township 13 North, Range 6 West, described by metes and bounds thus: Commencing at a corner 155 yards and 2 feet East of the SW corner of the NW Quarter of the North- east Quarter of said Section 8, witnessed by a red oak 6 inches in diameter bears South 38 degrees East 20 links and a red oak 6 inches in diameter bears South 231-2 degrees East 15 links; thence East 233 1/3 yards to a rock witnessed by a red oak 3 inches in diameter bears South 40 degrees East 12 links and a red oak 3 inches in diameter bears North 40 degrees East 6 links; thence North 155 2/3 yards to a rock witnessed by a red oak 5 inches in diameter bears North 81 degrees West 27 links and a red oak 5 inches in diameter bears South 37 degrees East 13 links; thence West 233 1/3 yards to rock witnessed by a red oak 6 inches in diameter bears North 54 degrees East 3 links, and a red oak 6 inches in diameter bears North 884 degrees West 17 links; thence South to place of beginning, containing 72 acres, more or less. LESS AND EXCEPT a part of the Northwest Quarter of Northeast Quarter of Section 8, Township 13 North, Range 6 West, described thus: Commencing at a point 155 yards and 2 feet East of the SW corner of NW4 of NEI of Section 8, Township 13 North, Range 6 West, witnessed by a red oak 6 inches in diameter bears South 38 degrees East 20 links, and a red oak 6 inches in diameter bears South 231-2 degrees East 15 links; thence North 155 2/3 yards; thence East 62 yards; thence South 155 2/3 yards; thence West 62 yards to the point of beginning, containing 2 acres, more or less. WHEREAS, the owners of the above-described property have i; requested the rezoning of said lots from R-1 residential to C-2 commercial and have made application for said rezoning in the proper manner; and WHEREAS, a public hearing has been held by the Planning Commission for the City of Batesville after proper notice having been published for the time and in the manner required by law; and WHEREAS, the Planning Commission has recommended the rezoning of said property from R-1 residential to C-2 commercial;. and WHEREAS, the City Council accepts the recommendation of the City Planning Commission to rezone said property; { BE IT NOW ORDAINED: t I The above-described property should be, and it hereby i `is rezoned to the classification of C-2 commercial; i jThat this ordinance should be published one time in a IInewspaper having a general circulation in Independence County, I jArkansas. i PASSED and APPROVED this day of July, 1981.
