AN ORDINANCE DEFINING PURCHASING AUTHORITY
AND PROCEDURE FOR THE BATESVILLE UTILITIES
COMMISSION.
WHEREAS, it is necessary to define the purchasing
authority and procedure and desirable to correlate this authority,
and procedure to that of other agencies of the City of Batesville
NOW, THEREFORE, BE IT HEREBY ENACTED BY THE CITY OF
BATESVILLE, ARKANSAS:
Section l: The Chairman of the Batesville Utilities
Commission, or his duly authorized representative, shall have
exclusive power and responsibility to make purchases of all
supplies, apparatus, equipment, materials, and other things
requisite for purposes of construction, repair, maintenance,
building, rebuilding, improving, demolishing, removing, operating
or preparing for operation of the Batesville Water and Sewer
Facilities and all associated equipment; and to make and enter
into all necessary or desirable contracts for work or labor to
be done, or material or things to be furnished for the benefit
of the Batesville Utilities Commission in carrying out any work
or undertaking associated with the Water or Sewer Department for
the use and benefit of the public as defined by local, state and
federal law or administrative rule or regulation, where the total
expenditure therefor is $1,000.00 or less.
Section 2: All purchases of supplies, apparatus,
equipment, materials, and other things requisite for construction
repair, maintenance, building, rebuilding, improving, demolishing,
removing, operating, or preparation for operating of the
Batesville Water and Sewer Facilities, contracts for work or
labor to be done, material and other necessary things to be
furnished to the Batesville Utilities Commission, where the
expenditure is greater than One Thousand Dollars ($15000.00) but
not exceeding Two Thousand Dollars ($2,000.00), shall be made or

contracted for by the Chairman of the Utilities Commission or
his duly authorized representative, only after the securing of
"bids" therefor; provided, however, purchases of less than Two
Thousand Dollars ($2,000.00) at state bid prices shall be exempt
from the provisions of this ordinance.
Section 3: Where the amount of expenditure for any
purpose or contract exceeds the sum of Two Thousand Dollars

($2,000.00), the Chairman of the Utilities Commission or his
duly authorized representative shall invite competitive bidding
thereon by legal advertisement in any local newspaper. Bids j
received pursuant to said advertisement shall be opened and read
on the date set for receiving said bids in the presence of the
Batesville Utilities Commission or its duly authorized representa!
Live. The Batesville Utilities Commission shall have exclusive
power, by majority vote, to award the bid to the lowest
responsible bidder; provided, however, that the Utilities

Commission may, by majority vote, reject any and all bids

received. !
Section 4: All ordinances or parts of ordinances in
conflict herewith are hereby repealed to the extent of such
conflict.
