ORDINANCE NO.
AN ORDINANCE AMENDING ORDINANCE # 797 AND THE BATESVILLE MUNICIPAL CODE
CHAPTER 10.28, SECTIONS 10.28.01 REGARDING THE REQUIREMENT OF A CONSUMER
DEPOSIT FOR WATER, SEWER AND GARBAGE SERVICES; PROVIDING EXCEPTIONS
THERETO; PROVIDING PENALTIES FOR VIOLATION THEREOF; DECLARING AN EMER-
GENCY AND FOR OTHER PURPOSES:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS:
Section 1: From and after the passage of this ordinance a deposit of
$25.00 shall be required for water service, $25.00 for sewer service and
a deposit of $20.00 shall be required for garbage service. The deposit
will draw no interest. The deposit shall be made to that agency of the
city in charge of collecting the water tax, sewer tax and garbage tax.
Section 2: At any time should the person in whose name the deposit is
made, asks for a refund of the deposit, and be entitled to a refund of
the deposit, the city agency in charge of collecting the water tax,
sewer tax and garbage tax shall compute the persons water, sewer and
garbage bill and refund the difference between the deposit and the
water, sewer and aarbage bill if there is any.
Section 3: No city water service shall be connected or turned on at any
location until the deposits required in paragraph number one above have
been made as required by this ordinance.
Section 4: No person or business entity presently using the city water,
city sewer or receiving garbage service and have already complied v.,ith
existing ordinances shall be required to make a deposit so lona as they
remain at the same address. If such person or business entity moves and
acquires a new address, a deposit as required by this ordinance shall be
made. In such case, credit will be given for the amount then held as a
deposit.
Section 5: Whereas, the city is losing water, sewer and garbage revenues
jbecause persons are moving without paying their water bill, sewer tax and
garbage tax, and whereas the water, sewer and garbage deposits at present
are not sufficient to cover many delinquent bills; and whereas due ;:o
this the city has lost water, sewer and garbage revenue, an emergency is
hereby declared and this ordinance shall be in full force and effect from
and after the date of its passage.
