HomeMy WebLinkAbout983,nuc` AX ORDINANCE #��� AN ORDINANCE ALLOWING THE MAYOR OR HIS DULY AUTHORIZED REPRESENTATIVE TO SELL ,!OR EXCHANGE MUNICIPAL SUPPLIES, MATERIALS AND EQUIPMENT WITHOUT COMPETITIVE BIDDING; ESTABLISHING A MAXIIHUM AMOUNT WHICH MAY BE SOLD OR EXCHANGED; PROVID- lING EXCEPTIONS THERETO; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS: ,!Section 1: Pursuant to act No. 28, section 7, of the Acts of Arkansas 1959, �as codified as Ark. Stat. Ann. 19-4427, the Mayor of the City of Batesville, ;Arkansas or his duly authorized representative may sell or exchange any !!municipal supplies, materials or equipment subject to the following sections of this ordinance. ` f ''Section 2: That the Mayor or his duly authorized representative may sell or 1exchange any municipal supplies, materials or equipment without competitive ;'bidding so long as the value of said municipal supplies, materials or equipment ;!to be sold or exchanged or item or lot to be disposed of as one unit of sup - !plies, materials or equipment does not exceed the sum of $2,000.00. ';Section 3: That prior to any sale or exchange of any municipal supplies, materials or equipment without competitive bidding as provided in this :ordinance, the Mayor or his duly authorized representative shall certify in ;writing to the governing body that in his fair opinion the fair market value `of such item or lot of items is less than the amount established by this feordinance. ;'Section 4: That any ordinance or parts of any ordinance in conflict herein !:are hereby repealed. :;Section 5: That the parts of this ordinance are severable and if any part or parts of this ordinance are declared unconstitutional or otherwise unlawful !;then the remaining valid portions of this ordinance shall remain in full force ;;and effect as though the invalid, unlawful or unconstitutional portions thereof j,were never made part thereof. E -Section 6: It is hereby found that the public interest will best be served ,by permitting the Mayor or his duly authorized representative to sell or ex- ;�change any municipal supplies, materials or equipment without competitive !!bidding so long as their value does not exceed the sum of $2,000.00, for the Treason that often times the publication cost of a notice to sell City property ;!would exceed the value of the property to be sold or would render the sale uneconomical; that the ordinances now in effect impose an undue financial ;burden upon the City whenever small items of personal property of the City are ,'to be sold. Therefore, an emergency is hereby declared to exist and this xordinance shall be in full force and effect from and after the date of its passage in order to preserve the public peace, health and safety. ;i ADOPTED this _Z3P-1> day of � ; 1982.
