AN ORDINANCE REZONING A TRACT OF LAND BEING ALL OF LOTS 4, 5 & 6, BLOCK SEVENTY-
EIGHT (78) OF MAXFIELD'S THIRD EASTERN ADDITION TO THE CITY OF BATESVILLE, INDEPENDENCE
COUNTY, ARKANSAS, FROM R-2 RESIDENTIAL TO C-2 COMMERCIAL.
WHEREAS, the owner of a tract of land being all of lots 4, 5 & 6, block seventy-
eight (78) of Maxfield's Third Eastern Addition to the City of Batesville, Independence
County, Arkansas, has requested the rezoning of said lots 4, 5 & 6, block seventy-
eight (78) frau R-2 Residential to C-2 Commercial and has made application for said
rezoning in proper manner; and
WHEREAS, public hearings have been held by the Planning CaYmission for the
City of Batesville, Arkansas after proper notice having been published for the
time and in the manner required by law; and
WHEREAS, the City Council for the City of Batesville has received reports
and recommendations from the Planning Commission and after due notice as required
b law, the Council has heard all
y persons desiring to be heard on the question
and has determined that the property's best use is comercial and that it should
be rezoned C-2 and that other property owners in the area will not be adversely
affected by the rezoning and that the general public interest and welfare will
not be adversely affected by said rezoning.
NOW, THEREFORE, BE IT NOW ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE,
Section l: That all of lots 4, 5 and 6, block seventy-eight (78) of Maxfield's
third Eastern Addition to the City of Batesville, Independence County, Arkansas,
should be and they hereby are rezoned to the classification of C-2 Commercial;
Section 2: That this Ordinance should be published one time in a newspaper
having general circulation in Independence County, Arkansas;
Section 3: That a copy of this Ordinance duly filed by the City Clerk shall
be filed with the Recorder of the County and recorded in the deed records of said
court;
