ORDINANCE NO.
AN ORDINANCE CLOSING THE UNUSED PORTION OF
21st STREET LYING SOUTH OF REYNOLDS STREET
IN THE CITY OF BATESVILLE, ARKANSAS
WHEREAS, a Petition was duly filed with the City Council of
!the City of Batesville, Arkansas, on the %,3 day of TC}L-i , 1982,

asking the City Council to vacate and abandon all that portion of
,21st Street lying South of Reynolds Street in the City of
jBatesville, Arkansas; and
WHEREAS, after due notice as required by law, the Council
has, at the time and place mentioned in the Notice, heard all
persons desiring to be heard on the question and has ascertained
that the street hereinbefore described has heretofore been dedicat-
ed to the public use as a street but has not actually been used by
the public generally for a period of at least five (5) years sub-
sequent to the dedication thereof; that all of the owners of the
property abutting upon the portion of the street to be vacated
have petitioned the City Council for such vacation and abandonment;
and that public interest and welfare will not be adversely affect-
ed by the abandonment of such street.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the
City of Batesville, Arkansas:

The City of Batesville, Arkansas, hereby releases, vacates
and abandons all its rights, together with the rights of the
public generally, in and to the street designated as follows:
That portion of 21st Street lying South of
Reynolds Street in the City of Batesville,
Arkansas.
SECTION II
A copy of this Ordinance duly certifed by the City Clerk
shall be filed in the office of the Recorder of the County and
recorded in the Deed Records of the County.

SECTION III
This Ordinance shall take effect and be in force from and
after its passage.

Twenty-first (21st) Street South of
Reynolds Street
PETITION TO VACATE
UNUSED AND UNOPENED STREET
Come Robert L. Slaughter and Mary Slaughter, husband
and wife, and Clyde Keene, by their attorney, Steve Bell, and
pursuant to Act 17 of the Arkansas Acts of 1945, state for their
petition to abandon a certain street for nonuse as follows:
(1) That Petitioners Robert L. and Mary Slaughter are

i the owners of the following described real property:
Lot 6, Block 13 and all of Block 14 of the
Fitzhugh Park Addition to the City of
Batesville, Arkansas.
That Petitioner Clyde Keene is the owner of the following des-
cribed real property:
Lot 5, Block 13 of the Fitzhugh Park Addition
to the City of Batesville, Arkansas.
(2) That said land described in paragraph 1 lies south
of and immediately adjacent to Reynolds Street.
(3) That as platted in the subdivision records of the

City of Batesville, Arkansas, Twenty-first (21st) Street, south

of Reynolds Street, is a street having a fifty (5 0 ) foot right -of-!
way.
(4) That there has been no attempt to open this street
!i or to use it for public purposes and such street has not been

actually used by the public for a period in excess of twenty-five
(25) years.
(5) That the Petitioners are owners of all lands which
abut the street hereinabove mentioned; that no other property
owner other than Petitioners will in any way be affected by the
jjvacation of such street.

fff (6) That the presence of the platted but unopened
I1 street on Petitioners lands greatly hampers the development and
use of such land without a corresponding benefit to anyone; that
the public interest and welfare will not be adversely affected by
the abandonment of such unopened street.

WHEREFORE, Petitioners request that the City Council
for the City of Batesville, Arkansas, set this Petition for hear-
ing as required by the terms of Act 17 of the Arkansas Acts of
1945, and that upon such hearing the City Council by ordinance
abandon the street hereinabove identified.

ORDER SETTING HEARING
Now on this 74day of U y , 1982, is presented the
Petition to Vacate the unused portion of Twenty-first (21st)
Street lying South of Reynolds Street, in the City of Batesville,
Arkansas, and Petitioners request the hearing be set on said
petition, from all of which the City Council for the City of
Batesville, Arkansas, finds:
(1) That a hearing shall be held on the 27th day of July ,
1982, in the City Hall at 7:00 P.M.
(2) That Petitioners shall be required to publish notice
of the hearing once weekly for two consecutive weeks in a news -
)aper having a general circulation in the City of Batesville,
krkansas.
THEREFORE, BE IT NOW RESOLVED that a hearing be held at
':00 P.M. on the 27th day of July ,1982, for the purpose of
searing the Petition to close the street set out in said Petition
and that notice of said hearing be published once weekly for two
consecutive weeks in a newspaper having a general circulation in
the City of Batesville, Arkansas.

NOTICE OF HEARING
TAKE NOTICE AND BE ADVISED that a Petition to vacate th
unused portion of Twenty-first (21st) Street lying South of
Reynolds Street, in the City of Batesville, Arkansas, was filed
by Robert L. and Mary Slaughter and Clyde Keene, in the office of
the City Clerk of Batesville on the 13th day of July, 1982, and
that a hearing shall be held on the 27th day of July , 1982,
in the City Hall at 7:00 P.M., at which time the City Council for
the City of Batesville, Arkansas, will consider the Petition to
Vacate the unused portion of said street.
All persons interested in this matter shall be heard at
the hearing set on the 27th day of July , 1982 at 7:00 P.M. or
as soon thereafter as the business of the City Council permits.

Your ordinance which was submitted to this office, satisfactorily meets
the requirements of Section 44 CFR 60.3 (d) of the National Flood Insurance
Program (NFIP) Regulations. On the basis of our acceptance of your
ordinance, your cotmnmity's eligibility in the National Flood Insurance
Program will be continued.
The date of your comnmity's Flood Insurance Rate Map (FIRD is the
effective date for the authorization of the sale of first and second
layer flood insurance coverage at actuarial rates for all new construction
and substantial improvements to existing structures within your camunity.
First layer coverage on structures built prior to the date of your FIRM
will continue to be made available at subsidized rates, unless substantial
improvements are made to the structure.
The actuarial rate zones and base flood elevations applicable to your
comrnm.ity are indicated on the FIRM. You should be aware that actuarial
rates for insurance on a structure increases as the first floor elevation
140- of the structure decreases below the base flood levels established for
your cotummity. In addition, on the effective date of the FIRM, the
FIRM supersedes all previous maps for the purpose of determining whether
individual properties are located inside or outside the area having
special flood hazards; and, after that date, new construction will be
charged actuarial rates which may be higher if the construction is not
built in compliance with the flood plain management requirements of the
ITFIP .
The effective administration and enforcement of your adopted flood plain
u anagemen.t regulations will enable your comrrn pity to substantially
reduce its future flood losses through the wise management of its flood
plains.
You should keep us advised, through your annual report, of any problems
associated with the administration of these regulations and of any
variances granted for construction not in accordance with the adopted
standards.
