AN ORDINANCE ADOPTING THE CITY OF BATESVILLE, ARKANSAS FLOOD w
HAZARD PREVENTION CODE; ADOPTING THE FLOOD INSURANCE RATE RAPS
AND FLOOD HAZARD BOUNDARY-FLOODWAY MAPS AND REVISIONS THERETO.
PROVIDING FOR PENALTIES FOR VIOLATION OF SAID ORDINANCE; PROVIDING
FOR THE FILING OF SAID CODE AND MAPS AND REVISIONS THERETO IN THER
OFFICE OF THE CITY CLERK; DECLARING AN EMERGENCY AND FOR OTHER
PURPOSES:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE,
ARKANSAS:
SECTION 1: That the City of Batesville, Arkansas Flood Hazard
Prevention Code prepared for the Batesville City Council in May,
1982 and the subject of a public notice which appeared in the
Batesville Guard on the 16 TH day of -TU L y 1982
and the subject of a public hearing on the ;'I day
of To 0 , 1982 is hereby adopted in full. That three
(3) copies of said code shall be placed on file in the office of
the City Clerk and shall be opened to public inspection.
SECTION 2: That the Flood Insurance rate maps and flood hazard
boundry - floodway maps refered to in said code and any revisions
thereto are hereby adopted. That three (3) copies of each set of
said maps shall be placed on file in the office of the City Clerk
and shall be opened to public inspection.
SECTION 3: No structure, building, fill or development shall
hereinafter be constructed, located, extended, converted or
altered without full compliance with the terms of said City of
Batesville, Arkansas Flood Hazard Prevention Code and other I
applicable regulations. Violation of the provisions of said
code by failure to comply with any of its requirements (including;
violations of conditions and safeguards, established in connection{
with conditions) shall constitute a misdemeanor and any person or';
corporation who violates said code or fails to comply with any of{
it requirements shall upon conviction thereof be fined not more
than One Hundred Dollars ($100.00) for each offense. Each day
during which such violation exists shall be deemed a separate
offense. Nothing herein contained shall prevent the City of
Batesville, Arkansas, or anyother governmental agency or any
private person from taking such other lawful action as is neces-
sary to prevent or remedy any violation.
SECTION 4: Whereas, the City Council of the City of Batesville,
Arkansas finds that the Flood Hazard areas of Batesville, Arkansas
are subject to periodic inundation which results in loss of life
and property, adversely affecting the economic welfare of the
citizens of Batesville, Arkansas, and whereas, this Ordinance is j
designed to minimize those public and private losses, and whereas,]
immediate passage of this Ordinance is necessary to effectively
protect those interest, an emergency is hereby declared and this j
Ordinance shall be in full force and effect from and after the
date of its adoption.

NOTICE
The public is hereby given notice that the City Council of
the City of Batesville, Arkansas will on the � Z42 ✓ day

of ta�� / 1982 consider for adoption a code entitled
"The City of Batesville, Arkansas Flood Hazard Prevention Code".
Said code is designed to promote the public health, safety and
general welfare and to minimize public and private losses due to
flood conditions in specific areas by provisions regulating use
of property in flood plains, requiring uses vunerable to floods
to be protected against flood damage at the time of intial

construction, controlling the alteration of natural flood plains,?
stream channels, and natural protective barriers, controlling the!
fill, rating, dredging, and other development in flood plains and;
preventing and regulating construction of flood barriers which
will unnaturally divert flood waters or may increase flood hazard'
to other lands.
Copies of said code and maps of said flood plains are open
to public examination from 8:00 A.M. to 5:00 P.M. in the office
of the City Clerk,
